TRUST DEED FOR ESTABLISHMENT OF A TEMPLE THIS TRUST DEED is made on this ________ day of ____________ between Sh.______________ s/o Sh._____________r/o _________________ hereinafter referred to as " the Donor" of the one part AND Sh. __________________, Sh.__________________, and Sh._______________ (hereinafter referred to as "the trustees," which expression shall include the trustee or trustees for the time being) of the other part. WHEREAS the founder is desirous of establishing a Hindu temple for worship and for the promotion and encouragement of Hindu culture and philosophy and for the said purpose proposes to provide a plot of land situated at ___________ more particularly described in the schedule annexed hereto and also to settle a sum of Rs.________ upon trust to the trustees for construction of the temple at the said plot of land. NOW THIS DEED WITNESSETH AS FOLLOWS: 1. In pursuance of his desire, the Donor hereby convey, assigns and transfers ALL that land described in schedule I annexed hereto and the sum of Rs.____________ for establishing a Hindu temple for worship and for the promotion and encouragement of Hindu culture and philosophy. 2. The trustees shall utilise the money provided by the donor for the construction of a temple on the said plot of land as per the plan described in schedule II annexed hereto and on completion of the said temple the deities of ________________________ shall be installed thereon in accordance with Hindu rites and ceremonies. 3. The trustees shall have power to appoint/ remove such no. of priests for performing Puja and for celebrating festivals and other employees for the upkeep and maintenance of the temple as they may think fit. 4. The expenses of the temple including expenses on celebrating festivals shall be met out of the income of the temple i.e. donation received /money offered to the deities. In case of any deficiency, the expenses can be met out of the corpus of the trust fund. In case of any surplus, the Trustees shall have power to invest such surplus funds in such securities/bonds as they may think fit. 5. The trustees shall also have power to borrow money for the expenses of the temple on the security of the trust property except the temple. 6. The trustees shall maintain proper books of accounts for the donation received /money offered to the deities and for the expenses incurred on various accounts, on a daily basis. The trustees shall also get the accounts audited by a Chartered Accountant as per the provisions of the Income Tax Act. 7. The matters relating to the trust will be decided by the decision of the majority of the trustees. 8. In case there is any vacancy amongst the trustees due to the death or resignation or incapacity of any trustee or otherwise the donor shall appoint other trustee to fill up the vacancy and in case the donor is not alive, the remaining trustees shall make the appointment. 9. The trust shall be a public charitable trust and the trust fund shall in no case revert to the donor of the trust or any of his descendents or to any other person. 10. The trust fund shall not be utilised for any other object except for those for which the trust has been created.
