All adult Indian Inhabitants residing at the addresses stated above hereinafter called & referred to as “THE LICENSEE” (which expression shall unless it be repugnant to the context or meaning thereof shall mean and include his / her heirs executors administrators & assigns) of the SECOND PART..

WHEREAS the Licensor / s is / are in lawful owner /s of the Flat / Room No. 701 on the Floor 7 th in the Building known as Sun City  Residency, Plot No.87/E87 in the Sector 3 Node Kharghar having an area of 1683 Sq.ft. 163 sq.mtrs.) Or thereabouts hereinafter referred as “THE SAID PREMISES”.  PREMISES”. 

POSSESSION AND WHEREAS:  THE LICENSEE being in need of space has requested the LICENSOR to grant his / her permission and LICENSE to use the said premises as here under described which the LICENSOR have agreed to upon terms and conditions hereinafter contained.

NOW THEREOF THIS AGREEMENT OF LEAVE AND LICENCE WITNESSESTH AS FOLLOWS: 1.  THE

permission and LICENSE to use occupy from for a Temporary  period of 11 month which shall commence from 1st May  2013 and shall expire on 31st March 2014 the said Flat together with all fixtures and fittings in the said Flat.

 THE LICENSEE shall use the said Flat for residential residential use only.  THE ONLY residents of The Said Premises shall be i) MISS.NAVYA SREE SURISETTI, ii) MISS.ARCHITA MODI, iii) MISS.ANSUPRIYA PRADEEP KUMAR, iv) MISS.RITU GARG and v) MISS.MADHUMITA KUSHWAHA being bona fide students of  National Institute Of Fashion Technology studying in the Second  year of the Master in Fashion Management program . Their home address is as follows respectively. Proof of Identity and Proof of  Address and College Identification are attached hereto. THE LICESNSEE undertakes that No individuals other than those identified herein may stay in The Said Premises either by day or by  night during the LICENSE PERIOD. THE LICENSEE undertakes that No visitors shall be allowed into the premises during LICENSE PERIOD under any pretext or for any reason except to visit on a short basis not exceeding one hour per visit. THE LICENSEE undertakes that No Parties or get-togethers or high volume music and other programs involving other than the above five individuals shall be permitted in THE SAID PREMISES at any time. The Five resident individuals identified herein undertake that they shall not return late in the night to the premises or misbehave or indulge in misconduct in the Premises or the Compound of the Society. The residents

to

keep

the

SAID

PREMISES and the lobby on the floor level in high state of  cleanliness by employing a daily servant for the purpose. purpose.

2.  The Licensor shall be deemed to be in judicial possession possession of  the licensed premises and the Licensee shall use and occupy  the premises with the license of the Licensor. The Said Premises shall always remain with the Licensor and the Licensee is only permitted to use the premises under this Agreement. It is agreed that it is not intended to create the relationship of landlord and tenant by execution of this Agreement of Leave and License.

3.  IN CONSIDERATION OF THE LICENSE and permission to use the said premises the LICENSEE has paid to the LICENSOR

sum

of 

Rs. 1, 00,000/-(Rupees: One Lacs Only) an advance upon the execution of this Agreement which the LICENSOR shall be entitled to Return to the LICENSEE when this Agreement is terminated subject to the deductions referred to in this Agreement. Thus in consideration thereof, the LICENSEE shall pay to the LICENSOR Monthly compensation sum of  Rs.23, 000/-(Rupees Twenty Three Thousand Only) for the 11 months from the 1st May 2013. After 11 months, rent will increase @ 10%. From the 12 month, the rent will increase by  10 pc on the rent in months 11 determined as above. The Licensees shall be singly (in the absence of continuity of any

others) or jointly be responsible for payment of the Full Rent each month even if any one of the abovementioned Licensees departs temporarily or permanently. The gross rent shall be deposited by the 7th of every month by the Licensee into the Licensor’s Bank Account.  Account.  

4.  (a) THE LICENSOR hereby covenants with the LICENSEE to duly and punctually pay the Electricity Charges.

(b) Water Charges, Association or Society contribution every  month paid by Owner. (c)

The Licensee shall not make or permit to do any 

alteration or addition to the construction or arrangements (internal or external) to the licensed premises without previous consent in writing from the Licensor. The minor day-to-day repairs such as replacement of fuses, fixing of  leaking water taps, minor maintenance of electrical/ sanitary  pipes, changes in the electrical system, crack in construction, etc. shall be the responsibility of the Licensee and shall be repaired / replaced by the Licensor at the cost of the Licensee or if undertaken by the Licensee with prior approval of the Licensor

5.  THE LICENSEE shall hand over the peaceful possession possession without demur to LICENSOR after completion of 11 Months.  The LICENSEE hereby agrees to a LOCK IN PERIOD of 11 months from 1st May 2013. Any extension shall be by mutual consent.

6.  TO USE SAID PREMISES only for the purpose mentioned in clause (2) above and not to use the same for any illegal or immoral or improper purpose. And not to cause, permit or suffer in any part thereof, anything which becomes nuisance or annoyance or cause damage/ loss to the LICENSOR or the adjoining owner or occupiers. Licensee shall not keep or store any goods or items which are combustible or explosive in nature or which are not permissible under law except domestic gas cylinders. Licensee shall not carry out any  unlawful

or

anti

social

activity

prohibited

under

the

prevailing Laws of the country.

7.

It is agreed between the parties hereto that all outgoings including all rates, taxes, levies assessment, non-occupancy  charges, etc, if any, in respect of the Said Premises shall be paid by the Licensee 

8.  To pay monthly compensation every month in advance to the LICENSOR, by the 7th day every month during the period of  this Agreement.

9.  NOT TO CLAIM ANY rights or interest in said premises or any  part thereof save and expect to use the same for the purpose mentioned above. 10. 

a) IN CASE THE LICENSEE desires to hand over the

said premises to the LICENSOR before the completion of the 11 month LOCK IN period referred to hereinabove, The LICENSEE can do so by giving one Month’s notice, and a compensation in lieu of the shortfall of number of months thereof between the LOCK IN period of 11 months and the actual months that LICENSEE has actually used THE SAID PREMISES until date of return hand over at the applicable rate during the period of shortfall. The LICENSOR will be entitled

to

the

deposit

amount

in

case

the

compensation paid is short. b) If the LICENSEE commits breach of any of the terms of  foregoing clauses clauses the LICENSOR one Month’s notice.  notice.  

11.  NOT WITH STANDING ANY thing contained here in it shall be lawful for the LICENSOR in the normal course course or in the event of the breach by the LICENSEE any of the terms and conditions of the said Agreement to revoke the License or permission granted, to the LICENSEE by Giving one months previous notice in writing of his intention and at the expiry of

the said period this agreement shall stand revoked and the owner shall refund the security deposit against the delivery of  vacant peaceful possession; in the event of termination upon event of breach of any terms and conditions by the LICENSEE, the deposit shall be refunded only after adjusting the short stay compensation worked on the same lines as detailed in Para 9(a) above and the balance shall stand payable FORTHWITH FORTHWITH from the LICENSEE to the LICENSOR .

12.   The Licensee shall allow the Licensor and the Licensor’s Licensor’s agents and servants, to enter the Licensed Premises at any  reasonable time for inspecting or repairing THE SAID PREMISES. 13.   The lease shall shall be terminable terminable under all or any any of the following following circumstances, namely:

a)  By efflux of time b)  In the event of non-payment of rent by the LICENSEE for a period of TWO months; c)  In the event of breach by either party of the terms, conditions and covenants hereof; d)  That if the scheduled premises or any part of it is severely damaged or destroyed due to any unforeseen circumstance or civil commotion, act of God etc. and these damages be not restored to by the LICENSOR

within the reasonable time or or if the scheduled premises is acquired compulsory by an authority, e)  The Lease may may be terminated terminated by either either party by giving 1 months (One) advance notice in writing subject to the Lock-in period agreed to by the Licensee as detailed in Para 9 above.

the

LICENSOR

immediately upon the expiry of the said term or on earlier termination, if any, in good and tenantable conditions, subject to reasonable wear and tear, upon which the LICENSOR shall return the Security Deposit free of interest less any lawful deduction stipulated in clause 5 herein above immediately to the LICENSEE within 15 days of return of possession by the Licensee and without any delay.

14.  All notices or intimations herein shall be in writing and in English language only. Any notice/s to the Licensee shall be deemed to be sufficiently given if posted by the Registered Post to their address as mentioned herein. And any notice to the Licensee shall be sufficiently given if posted by the Registered Post A...D. at the address of the Licensed Premises mentioned

above.

15.   The LICENSOR shall have the right to make any deductions from the deposit at the time after making an assessment of  the damages to the Said Premises Premises (other than normal wear and tare) or amenities which shall be determined at the sole and final discretion of the LICENSOR and shall be accepted without demur by the LICENSEE. 16.   The Licensor shall be entitled to impose penalty calculated at the rate of Rs.1500/- per day should the Licensee fails to hand over vacant and peaceful possession of the licensed premises
