TILT TAIL LIFT SERIES Loading Capacity: 500kg – 4,000kg Our 3t Tilt is the first Tailgate in market with a 3t lifting capacity. The new mechanical design which has multiple scalar ribs hidden behind the 5 mm check plate allows forklifts to drive over. The push cylinders made the tailgate working comfortably, the trolley stops and returning tube are a standard feature. With up to 2.7M long platform to be used as rear door, it’s certainly top of its game.

This modern slider model range includes the use of aluminium profiles for oil transport reducing the hose lengths. High tensile steel and powder coating are offered as standard for all steel components. A hydraulic motor drives the slide system and gives the smoothest most reliable extend / retract movement in the industry. The ZSS model range is optimized for high C measure and maximizing ground clearance. This is the heaviest duty slider in the ZEPRO range. General Terms & Conditions of Sale 1
DEFINITIONS In these General Conditions of Sale (“Conditions”) “Account” means the account maintained by Austlift in the name of the Purchaser to facilitate the purchase of goods from Austlift. “Austlift” is a trade mark or products brand which is owned by Pacific Lifting Pty Ltd. and registered in Australia “Purchaser” means the company, firm, person or other entity identified as the applicant on the “Credit Account Application” form published by Austlift from time to time and/or in whose name an account is kept and/or who acquires goods and/or services from Austlift from time to time.

APPLICATION All contracts arising between Austlift and the Purchaser in respect of goods supplied or to be supplied by Austlift shall be subject to these Conditions and any other conditions expressly agreed to in writing by Austlift and the customer to the exclusion of all other terms and conditions contained in any order or other documents submitted by the customer shall form part of any such contract.

ORDERS All orders must be placed in writting and sent via email or fax with our quotation number attached. We do not accept verbal order in general unless this is in urgent or COD payment.

PRICE All prices published or quoted are subject to change without notice and goods will be billed at prices existing at the time of invoicing. Orders with conflicting pricing will warrant amendment for correction and confirmation by Purchaser prior to Austlift processing their purchase. Back orders may be subjected to prices in effect, while Indent orders will include any additional currency exchange rate variations upon delivery or invoice. All prices are exclusive of G.S.T however total of G.S.T payable will be stated on the tax invoice. Discounts including special net pricing may be offered at times; such prices are only applicable for certain project, period or product and warrants Austlift discretion at all times.

PAYMENT Unless otherwise agreed in writing by Austlift, the Purchaser shall pay Austlift the total amount owed for goods supplied to the Purchaser and set out in Austlift’s invoice before delivery. For accounts customers a penalty of 1.5% per month shall also applicable to all overdue account past sixty (60) days of invoice. In the event that the Purchaser fails to pay the total amount owing in respect of goods supplied by the Due Date, Austlift may require the Purchaser to pay to Austlift by way of liquidated damages, a default charge being a sum which is calculated by the application of the daily percentage rate which is 2% above Austlift’s overdraft interest rate at the time, on the unpaid balance of the amount due from the Due Date until the total amount outstanding is paid in full. Austlift reserves the right to withhold supply of goods if terms of payment are not adhered to by the Purchaser. Indent orders warrant security of an irrevocable letter of credit payable within fifteen (15) days from time of delivery, and no settlement discount shall apply on such invoice. We accept EFT or cheque for customers who have credit accounts with us. We accept cash or credit card payments for cash sales.

MINIMUM INVOICE VALUE Without limitation, Austlift reserves the right at all times to reject orders with a pre-tax value less than $50.00. In the event that Austlift, in its discretion, decides to accept orders with a pre-tax value less than $50.00, the Purchaser shall pay Austlift an administration and processing charge with respect to the relevant order equal to the difference between the pre-tax value of that order and $50.00.

DELIVERY a. If Austlift specifies particular terms of delivery, carriage and insurance with respect to goods in a quotation provided by Austlift to the Purchaser, those terms and conditions will apply to the delivery, carriage and insurance of the relevant goods. b. If Austlift does not specify terms for delivery, carriage and insurance within a quotation provided to the Purchaser or there is no quotation, the purchaser shall arrange his own transport for the order. c. Austlift can arrange a transport service for your order at your cost. Deliveries are often arranged via our selected carrier on general freight (based on logistics and most economical pricing structure), and charges, where applicable are invoiced to customers accordingly. d. Any (part or complete) orders sourced via another branch shall incur freight transfer charges unless or until goods were to accompany general monthly stock transfers.

DIMENSIONS AND MASSES Dimensions and masses published or quoted with respect to goods supplied by Austlift are based on standards and manufacturing specifications, therefore must be considered as approximate and for guidance only. All such measurements are subject to commercial tolerances and may also be subject to change without notice.

CLAIMS BY THE PURCHASER a. All goods sold will be deemed to be of the required quantity and type unless a claim specifying particulars of deficiencies or incorrect type is made within seven (7) days after receipt of the goods by the Purchaser. b. Where products are on-forwarded by goods air, rail or carrier nominated by the Purchaser, then a receipt from the airline, railway or carrier shall be considered adequate proof of delivery and Austlift’s liability with respect to loss or damage to the goods will cease upon delivery of the goods to the carrier. c. Where Austlift accepts responsibility for delivery of the goods, Austlift will not be liable to the Purchaser in relation to defective goods unless the Purchaser gives notice of the defect to Austlift in writing within seven (7) days after receipt of goods by the Purchaser. d. Except as specifically provided to the contrary in these conditions, Austlift shall in no case be liable in any way for goods damaged in transit.
10 CANCELLATIONS AND RETURNS FOR CREDIT a. Orders can only be cancelled or goods returned for credit with the prior written agreement of Austlift provided that the goods are returned in the same re-saleable conditions as when they were originally sold. Goods accepted for return must be despatched by a carrier nominated by Austlift, only after receiving a credit return authority number from Austlift (invoice number and date are required on all claims). Returns due to purchase error will incur a restocking charge of 15% and transportation costs of products will be for account of the Purchaser. b. Any goods specifically made and or procured on behalf the Purchaser, that meet the Purchaser’s specific request are not refundable for credit. 11 DELAYS IN DELIVERY Austlift will use its best endeavors to meet specified delivery dates and whether or not a delivery date is specified Austlift will be under no liability of any kind for any delay in delivery from any cause whatsoever. If for any reason beyond the control of Austlift, orders cannot be filled at the time stipulated by the Purchaser, Austlift shall be entitled to determine the relevant contract of sale and the Purchaser shall not have any claims against Austlift arising out of such cancellation, without prejudice to the rights of Austlift to recover all sums owing to it in respect of goods or services provided prior to the date of such determination. 12 PRODUCT SUITABLITY Except to the extent that Austlift has made express representations in writing (whether in catalogue or otherwise) as to safe working loads, the Purchaser shall be responsible for determining the fitness of goods sold by Austlift for the purpose for which they are intended and acknowledges that Austlift is not aware of that purpose and that he has not relied on Austlift’s advice. 13 LIABILTY 13.1 Subject to statutory warranties that cannot be excluded, Austlift shall not be liable for any loss or damage whatsoever and howsoever arising whether direct, indirect or consequential or in respect of any claim whenever and however made for any loss or damage deterioration, deficiency or other fault or harm in the goods manufactured and/or delivered, work executed or services provided by or on behalf of or in any arrangement with Austlift or occasioned to the purchaser or any third or other party or to his or their property or interest and whether or not due to the negligence of Austlift its servants or agents.

As soon as any of the facts or matters which form any part of any claim or complaint whatsoever become known to the purchaser, the purchaser shall within fourteen (14) days notify Austlift in writing of the same. Austlift shall not be liable in any circumstances for any; (i) defects or damages caused in while or in part by misuse, abuse, neglect, electrical or other overload, non-suitable lubricant, improper installation, repair or alteration (other than by) or accident. (ii) any transport freight charges, installation, removal, labour or other cost; (ii) defects in goods not manufactured by it but endeavour to pass on to the purchaser the benefit of any claim made by Austlift and accepted by the manufacturer of such goods under a warranty given by the manufacturer of such goods provided that nothing contained in this subparagraph shall limit the rights of the purchaser to proceed against Austlift pursuant to the Trade Practices Act 1974. (iv) technical advice or assistance given or rendered by it to the purchaser or not in connection with the manufacture, construction or supply of goods for or to the purchaser provided always that Austlift has rendered such services with due care and skill and that any material supplied in connection with those services are reasonably fit for the purpose for which they are supplied. The exemptions, limitations, terms and conditions in these terms and conditions shall apply whether or not the loss or damage is caused by negligence or actions constituting fundamental breach of contract.
14. DEFAULT BANKRUPTCY ETC. If the Purchaser is in default in making payment for any goods whether the subject of the same or different orders, or if the purchaser being an individual shall become bankrupt or being a corporation shall take or have taken against it any steps having the object of winding-up or placing the Purchaser under any form of insolvency administration, Austlift shall be entitled by notice in writing to the Purchaser to require re-delivery to Austlift, at the cost and expense of the Purchaser of all goods which have not been paid for as aforesaid and for the purpose of recovering the goods. Austlift, its servants or agents may enter any land or building upon which Austlift believes the goods may be located within business hours without notice. 15. TITLE IN GOODS Notwithstanding anything to the contrary express or implied in these Conditions between Austlift and the Purchaser: a. Property in all goods supplied by Austlift to the Purchaser (“Goods”) shall remain with Austlift and shall not pass to the Purchaser until Austlift has received payment in full for the Goods and until all outstanding debts owed by the Purchaser to Austlift arising from the operation of the Account have been paid; b. Until such time as Austlift has received payment in full for the Goods and until all outstanding debts owed by the Purchaser to Austlift arising from the operation of the Account have been paid, the Purchaser shall hold the Goods as bailee for Austlift and shall store and identify the Goods in a manner which enables them to be clearly identified as Goods belonging to Austlift. c. As agent for Austlift, the Purchaser is authorised to sell any Goods supplied to the Purchaser by Austlift to third parties prior to the Due Date which is applicable in relation to payment for such goods. In the event of such sale, the Purchaser shall specifically earmark monies resulting from such sale and shall place the monies into a separate account to be held on trust for Austlift until such time as payment for those goods is made to Austlift, The Purchaser shall not represent to third parties that it is selling the Goods as agent for Austlift; d. In the event that the Purchaser fails to pay Austlift for Goods supplied by the Due Date, the Purchaser hereby agrees to deliver up the Goods to Austlift upon demand by Austlift and consents to Austlift retaking possession of the Goods and for this purpose the Purchaser authorises Austlift without notice, to enter upon the Purchaser’s premises in which such goods are stored to collect the Goods; e. In the event that the Purchaser commits an act of bankruptcy or where the Purchaser is a company, has a receiver, administrator or liquidator appointed to it or goes into any other form of insolvency administration, Austlift shall be entitled to immediate possession of the Goods supplied by it to the Purchaser remaining at that time in the possession of the Purchaser and is authorised to enter upon the Purchaser’s premises to collect such goods without prejudice to any other rights of Austlift; f. If Austlift retakes possession of any of the Goods pursuant to sub-clause (d) or (e) above, Austlift shall have the right to sell the Goods to any other party; and, g. The parties acknowledge that no charge or mortgage is intended to be created over the Goods supplied by Austlift to the Purchaser.
10 RISK The goods shall be at the Purchaser’s risk from the time of the first occurrence of any of the following events: a. the passing of property to the Purchaser; b. the physical delivery of the goods to the Purchaser; or c. the physical delivery to a carrier or other bailee whether named by the Purchaser or not Austlift shall be under no obligation to give its Purchaser a notice referred to in Section 35(3) of the Sale of Goods Act 1923. 17 DISCOUNTS NULLIFIED BY RECOVERY PROCEEDINGS If it becomes necessary to institute legal proceedings to recover unpaid debts to Austlift, all discounts showing on unpaid invoices become null and void and the total list prices showing become payable. 18 COSTS OF RECOVERY PROCEEDINGS In the event of the Purchaser’s default under these Conditions, the Purchaser shall pay to Austlift upon demand, all costs and expenses, including all recovery and legal costs (assessed on a solicitor and own client basis) incurred by Austlift in the enforcement of its rights with respect to that default. 19 CHANGE IN OWNERSHIP / EFFECTIVE CONTROL The Purchaser agrees to notify Austlift in writing of any change in ownership or effective control of the Purchaser within seven (7) days from the date of such change in effective control or ownership and indemnifies Austlift against any loss or damage incurred by Austlift as a result of the Purchaser’s failure to notify Austlift of any such change. 20 JURISDICTION The parties agree that the terms and conditions applying to any credit account opened in the name of the applicant and any other contract between Austlift and the Purchaser shall be governed by the laws of the State of New South Wales in force for the time being and from time to time, and the parties irrevocably submit generally and unconditionally to the jurisdiction of the Courts of New South Wales in respect of claims, proceedings and matters arising out of or in respect of the said credit account or any said contract. 21 PURCHASERS AUTHORITY The Purchaser agrees to be bound by the Terms and Conditions of Sale for Delivery. Claims on Delivery, Returned Goods, Transport Charges, Pricing Warranty and Written Contracts, when and where as stated on the current price list, invoices and/or notice sent to all customers of Austlift. If the Purchaser is a trustee, the directors warrant that they have authority and power to enter into this agreement and personally guarantee the performance of all the trusts obligations under this agreement. The Purchaser acknowledges that Austlift is entitled to presume that any person purporting to have the authority to bind the Purchaser to a contract in respect of goods and/or services from Austlift, has the authority they claim. 22 NOTICES Any notice by one party to the other shall be sufficiently served personally or by facsimile transmission, or if posted, by pre-paid post to the party to be served at the registered office of that party or its last known place of business or address and shall be deemed to have been received; a. within three (3) business days of the date of posting if served by post to an address in Australia b. within fourteen (14) days of the date of posting if served by post to an address outside of Australia, and c. immediately upon receipt of a successful transmission report by the sender if served by facsimile transmission. 23 CHARGE The Purchaser hereby charges with payment of any indebtedness to Austlift all beneficial interest (freehold and leasehold) in land and personal property held now or in the future by the Purchaser. Austlift may lodge a caveat noting the interest given by this charge on the title of any property of the Purchaser whenever it so wishes. 24 SERVICE The parties agree that service of any notices, demands, proceedings; statement of claim, suits or actions (process) upon the Purchaser may be effected by Austlift or its solicitors sending such process by prepaid post to the address given in the Credit Application as the address of the Purchaser. Services shall be deemed to have been effected two business days after the posting of the process.
