MOOT COURT SAMPLE SCRIPT COURT: Call the case. INTERPRETER: For hearing, Criminal Case No. 12345, People of the Philippines vs. Iris Victoria Merin. COURT: Appearances. PROSECUTOR PRESTOZA: For the government. ATTY. TAPIRE: For the defense. COURT: Ready? PROSECUTOR PRESTOZA: Ready Your Honor. COURT: Call your witness to the witness stand. Direct Examination to the Investigator-on-Case Prosecutor Fernando: I’m calling on SPO2 Anthony Zamora Interpreter: Do you swear to tell the truth, all the truth and nothing but the truth in this case? Witness: Yes Court: Please state your name and other personal circumstances. Witness: SPO2 Anthony Zamora, 29 years old, single, member of Investigation division in Kalibo Police Station and a resident of Brgy. New Buswang,Kalibo, Aklan. Court: Your witness. Prosecutor Viray: This witness, your honor SPO2 Anthony Zamora will testify on the Progress and Final Report of the case. May we proceed, your honor? Court: Proceed. Prosecutor Fernando: May you read this document Ma’am. Script of Investigator on Case (To be read) SPO2 Anthony Zamora: SUBJECT: Progress and Final Report That on or about 3:00am of September 01, 2013 at Purok 2 C.Laserna St. Kalibo, Aklan shooting incident transpired wherein victim identified as one Luz Estollosso Fernando, 21 years old, single, a native of Sebaste, Antique and presently residing at 2 C.Laserna St. Kalibo, Aklan, was shot by the suspect identified as one Michael Macahilig a.k.a. “Mike”, 24 years old, caretaker, single, and a resident of 2 C.Laserna St. Kalibo, Aklan. 3. Initial investigation conducted showed that on cited TDPO, while the victim was walking on her way home along Purok 2 C.Laserna St. Kalibo, Aklan. Suddenly, she noticed that “Mike” was following him. When she reached the corner of the street, Mike tried to get her bag but she resisted and used her knowledge in YawYan as self-defense, but the guy was too strong and decided to use “fan knife” and the suspect receeive 2 inches cut on his left arm. The suspect drawn his gun and shot the victim twice that caused victims immediate death. The suspect was caught immediately by the concerned citizens.

4. Medico legal experts found 2 bullets on the left part of the body of the victim that caused her immediate death. 5. . Forensic Ballistician identified that the revolver gun confiscated on the house of the victim is the sole gun used on firing the bullets because of the same striations found on a test bullet fired on the same gun. 6. That, based on the aforesaid, case of violation of “HOMICIDE” which is defined and penalized under Art.249 of Revised Penal Code (RPC) of the Philippines were charged against suspect. Prosecutor Fernando: I respectfully request your honor, that the report in Exhibit A be marked as Exhibit A-1 Court: Mark it. Q. Could you please explain this report in simple terms for an ordinary person to understand Sir? A. The incident transpired last September 01, 2013 at around 03:00 am, the suspect named Michael Macahilig tried to steal the bag of the victim identified as one Luz Fernando but she resisted and fought with the suspect. She used her “fine knife” but the suspect had a gun and shot her twice on the left part of her chest. We recovered a revolver gun during our search operation on the suspect’s house and recovered a revolver gun. Then, I brought the recovered gun and the recovered bullet to the crime laboratory to conduct examination. Q: Are you sure that there is no falsification happened during the transfer of the evidence? A: Yes. Court: Cross? Atty. Fernando: No further questions, your honor. Direct Examination of the Witness Prosecutor Joey Conson: I’m calling on PINSP CHARLENE L. AGRITO. Prosecutor Joey Conson: This witness, Your Honor, PINSP Charlene I. Agrito, will testify on the authenticity of the photographs taken by her to prove the following: (i) that the photographs taken in the crime scene are genuine and authentic; (ii) and that the photographs taken will establish the crime committed. May we proceed, Your Honor? Court: Proceed. Q: You declared that you are a Police Officer, PINSP Agrito, where did you finish your baccalaureate degree? Q: When did you graduate? Q: Are you a licensed criminologist? Q: When did you pass the criminology board examination? Q: Aside from your baccalaureate degree, do you have any post graduate studies? Q: Can you state it Miss Witness? Q: Where are you presently connected? Q: What is your present designation? Q: Since when have you been employed as a Forensic Photographer? Q: Since you became a licensed criminologist and a forensic photographer, have you attended seminars and undertaken training in connection with the practice of your field? Q: When and where? Q: Miss Witness, Is this work you’re performing, can it be equally done by other Photographer specifically commercial photographers? Q: Why is that so? Q: Have you testified as a Forensic Photographer in cases before courts of justice? How many criminal cases so far have you testified? What kind of criminal cases have you testified?
