And is this Michael?

Yes.

18

My name is Carrie.

19

Carrie, I’m at – I’m in an El Monte jail. And, uh, Homicide –

20

U

22

G

26 27 28

Tr

Uh, there was nothing in court. They said “Homicide

detectives wanna speak to me.”

Exactly. So, I’m in the El Monte jail right now, waiting for

Okay. Wait one second, Michael. We’re getting Anthony. 7

Mmnh-mmnh.

4

U

Hello?

5

G

Anthony.

6

U

Is that you Mike?

7

G

Yeah. I don’t know what’s going on. But, they have me in an

ns

2

El Monte jail right now saying that I need to speak to some Homicide

9

detectives in El Monte. U

at

10

io

8

Uh-huh. Well, that explains it, then. Well, you don’t have to

talk to them, obviously. And you definitely shouldn’t. And tell them that

12

“On advice of counsel, you were specifically told not to speak to them.”

ul

11

G

Okay. And then, where do I go from here, I mean?

14

U

They’ll take you back.

15

G

I’m being slammed all around here and there. They’re not

Tr

ib

13

giving me any air. They’re putting me in a cell where I’m claustrophobic.

17

El Monte Station is fine. They have me in an open cell. But, they’ve had

18

me in 23 and a half hour lockdown, not being able to make calls to my

19

attorney. I asked for medical advice. They – they refused medical

20

advice for two days where I almost had a freaking attack and collapsed.

ls

&

16

21

Tr

23

ia

22

U

What do you mean an attack?

G

Like I have anxiety attacks.

U

Oh. Okay. Well, we could probably get an order to have you

24

seen, uh, by – by a prison, uh, or jail psychologist or psychiatrist for

25

appropriate medication. But, you know, the – the immediate order of

26

business here is just don’t, uh, – you know, just don’t make any

27

statements. Just say *** your lawyer on a related other case and you

28

were advised not to talk. Simple as that. 8

Transcript*Time*00:37* Real*Time*June*17,*2008,*2:25*pm*

1 2

G

Okay. I don’t even know what –

what I’m here for. I mean, are they – what are they trying to do, I mean?

3

U

I mean – I mean, you know, the other thing you could do is try

4

to get their cards. And I can give them a call, once you find out who they

5

are. G

Okay.

7

U

And you could tell them that I’m happy to talk to them. Uh,

ns

6

but, uh, yeah, obviously, ***. But, uh, obviously, *** they can – they give

9

you – if you can get their card, and I get the information from you, or they

at

10

io

8

can feel free to call me.

11

All right, Anthony. I know I’ve been refused calls earlier.

ul

G

Uhm, if you can make sure, the office, like if I have to call you, again. I

13

mean, I know – uh, I know it could be expensive. But, –

14

U

ib

12

Well, it’s not really that. If you were refused a call, it’s

probably ‘cause you got put on hold or something. And then, the time

16

limit ran out. But, we’ll take your call for sure.

17

U

Tr

15

Yeah, he – uh, if the receptionist picks up in time, Michael,

then, automatically, you’re sending a ***, uh, *** line. So, if – if you ***

line, ***.

20

G

22

ls

U

Mmnh. All right. Well, I’ll tell you what. I don’t know how

much longer we’re gonna be able to see you on this thing here. So, what

Tr

23

I’m just like literally freaked out that they’re trying to throw

everything on my towel, now.

ia

21

&

18

24

I’d say is just, uh, if the police come – it’s kind of odd that they would be

25

so late. You would think they would have tried to talk to you earlier. But,

26

uh, just let them know that you’re represented and that you were advised

27

not to speak. But, I’m more than happy to talk to them. And, uh, you,

28

possibly, might talk to them. But, I need to, obviously, talk to them first, 9

Manslaughter. They’re sayin’. Some, uh – they picked me

DNA just places you there. It doesn’t mean you did it.

you’ve got a reason for being there, you know, if that’s, uh, your house or

she called him over. And they did the fucking wild thing and all that shit.

4

And two hours later, he left, she called the cops and said he came over

5

and fucking raped her and all that. And they took her to the hospital and

6

took tests and all that shit. And – and he lied about it because he was

7

hooked up with this other chick, at the time. So, he fucking lied about it.

8

And they – so, they fucking did him, because his DNA was in her. And,

9

you know, it – it – and then, he tried to tell them the truth. And, you

at

io

ns

know, they – uh, he – it worked out because she ended up telling them,

G

Yeah, so, she—so she could take the kid away.

20

D

Well, they all say that, man.

Although, it’s got to be killing you not knowing what you’re charged with –

12

I mean, not knowing what the fuck – what they have on your ass. You

he’s, uh, it’s great, uh, stories. It’s that reasonable doubt, that the jury

has to consider. You’re doing the – you’re doing heavy lifting for the

attorney, ‘cause that’s what he gets paid to do. Right? G

Yep.

D

You got to admit, most people in jail don’t have much of an

imagination, do they? G

9

D

I don’t think so.

10

G

Nope.

11

D

Nope? Now, attorneys have good imaginations.

12

G

13

D

But, you’re different. And I’m different.

Attorneys’ imagination is to live in a big house and having all

21

D

Well, that’s bragging rights for those guys. That’s a trophy. It

would be a trophy for this guy. You know, why don’t you – you know, what if you walked in there with your idea and told the jury “My client did

this, this, this and this. Yeah, he was in there. He’s not trying to deny it.

He went there and he did this, this and this. Convict him if – of the – of,
