Pasal 1

:  Nama proyek ditentukan oleh Owner Owner seperti berikut ini : Pembangunan Pembangunan Mess Sabang di Banda Aceh

Pasal 2

: Tempat dan lokasi pekerjaan ditentukan oleh Owner seperti berikut ini : Banda Aceh

Pasal 3

: Item-Iten Pekerjaan yang harus dikerjakan dan diselesaikan oleh Kontraktor Pelaksana ditentukan oleh Owner dalam : Kontrak Kerja dan dan Bill of Quantity

Pasal 4

: Sumber Dana Proyek berasal dari : APBK SABANG TAHUN ANGGARAN 2015 (OTSUS)

BAB II

KETENTUAN UMUM PELAKSANAAN

Pasal 1

: Penanggung Jawab Pelaksanaan ( Kontraktor Pelaksana ) 1. Berdasarkan Kontrak Kerja yang dibuat oleh Owner dengan Penyedia Jasa Pelaksana Konstruksi, maka Kontraktor Pelaksana untuk proyek seperti yang disebutkan dalam BAB I diatas adalah Perusahaan seperti yang disebutkan dalam Kontrak Kerja Fisik.

2. Kontraktor Pelaksana harus menyelesaikan pekerjaan secara seluruhnya sesuai dengan ketentuan-ketentuan di dalam Dokumen Kontrak. 3. Tugas dan kegiatan Kontraktor Pelaksana adalah seperti yang disebutkan dalam Keputusan Menteri Permukiman Dan Prasarana Wilayah Nomor : 332/KPTS/M/2002 Tanggal 21 Agustus 2002 Tentang Penyedia Jasa Pelaksana Konstruksi atau menurut perubahannya jika ada kecuali ditentukan lain oleh Owner dalam Kontrak Kerja Fisik. 4. Kontraktor Pelaksana harus mengajukan struktur organisasi pelaksana lapangan proyek kepada Owner yang didalamnya tercantum beberapa tenaga ahli Kontraktor Pelaksana dengan posisi minimal seperti berikut atau sesuai yang diajukan: 1. Project manager 2. Site Manager 3. Quality Engineer 4. Quantity Engineer 5. Arsitek 6. Supervisor Lapangan 7. Surveyor 8. Draftman 1

9. Administrasi Proyek 10. Operator Computer 5. Jumlah personil atau tenaga ahli yang ditempatkan harus sesuai dengan  bobot pekerjaan yang ditangani dit angani dan disetujui oleh Konsultan Manajemen Konstruksi dan Owner. 6. Semua tenaga ahli yang namanya tercantum dalam struktur organisasi lapangan proyek yang diajukan oleh Kontraktor Pelaksana harus berada dilokasi pekerjaan minimal selama jam kerja. 7. Pengantian tenaga ahli oleh Kontraktor Pelaksana selama proses  pelaksanaan pekerjaan harus diketahui dan disetujui oleh Konsultan Manajemen Konstruksi. 8. Project Manager harus mengajukan ijin tertulis kepada Owner dan diketahui oleh Konsultan Manajemen Konstruksi serta Konsultan Supervisi jika hendak meninggalkan lokasi pekerjaan dalam jangka waktu lebih dari 3 hari. 9. Konsultan Supervisi berhak mengajukan kepada Owner dan Konsultan Manajemen Konstruksi untuk pengantian tenaga ahli Kontraktor Pelaksana yang berada dilokasi pekerjaan jika tenaga ahli tersebut dinilai menghambat pekerjaan dan tidak mampu menjalankan tugasnya dengan  baik. 10. Tenaga ahli yang ditempatkan dilokasi pekerjaan oleh Kontraktor Pelaksana harus mampu memberikan keputusan yang bersifat teknis dan administratif di lokasi pekerjaan. Pasal 2

: Sub Pelaksana Pekerjaan / Sub Kontraktor 1. Penunjukan Sub Pelaksana pekerjaan / Sub Kontraktor hanyalah dapat dilakukan dengan sepengatahuan dan rekomendasi tertulis dari Konsultan Manajemen Konstruksi serta mendapat persetujuan dari Owner.

2. Apabila hasil pekerjaan Sub Pelaksana tidak memenuhi semua  persyaratan di dalam kontrak Kerja ataupun tidak memenuhi target  prestasi yang harus dicapai pada suatu tahap pekerjaan, maka Konsultan Supervisi berhak menginstruksikan kepada Kontraktor Pelaksana untuk

3. Kontraktor Pelaksana tidak dibenarkan untuk meninggalkan kewajibannya dengan cara menyerahkan Kontrak Kerja sebagian atau seluruhnya kepada pihak lain (Sub Pelaksana Pekerjaan) tanpa seijin atau  persetujuan Owner. 4. Apabila tidak disebutkan dalam Kontrak Kerja, maka Kontraktor Pelaksana tidak dibenarkan untuk men-sub-kan sebagian pekerjaan yang menjadi kewajibanya tanpa persetujuan Owner dan Konsultan Manajemen Konstruksi. 5. Dalam hal sudah mendapat persetujuan Owner dan Konsultan Manajemen Konstruksi, maka Kontraktor Pelaksana tetap bertanggung  jawab penuh atas segala kelalaian dan kesalahan-kesalahan yang dibuat oleh Sub Kontraktor, sehingga kesalahan dan kelalaian tersebut merupakan kesalahan dan kelalaian Kontraktor Pelaksana sendiri. 6. Sub Kontraktor adalah pihak-pihak yang mempunyai Kontrak Kerja langsung dengan Kontraktor Pelaksana, yaitu dalam menyediakan dan mengerjakan bagian-bagian pekerjaan khusus sesuai dengan keahliannya. 7. Kontraktor Pelaksana tetap bertanggung jawab sepenuhnya atas hasil  pekerjaan Sub Kontraktor. Pasal 3

: Gambar Pelaksanaan ( Shop Drawing ) 1. Kontraktor dengan biaya sendiri harus membuat Gambar Pelaksanaan (Shop Drawing) untuk pekerjaan-pekerjaan yang memerlukannya, terutama untuk pekerjaan-pekerjaan yang Gambar Detailnya tidak dijelaskan dalam Gambar Bestek.

2. Pekerjaan-pekerjaan yang memerlukan Shop Drawing ditentukan oleh Konsultan Supervisi dalam masa konstruksi. 3. Kontraktor Pelaksana tidak dibenarkan melakukan pekerjaan sebelum Shop Drawing yang menjadi kewajibannya di setujui oleh Konsultan Supervisi. 4. Shop Drawing tidak boleh merubah/merevisi Gambar Bestek kecuali atas  persetujuan Konsultan Perencana.

Pasal 4

: Gambar Lapangan Dan Dokumen Lapangan 1. Kontraktor Pelaksana harus menyediakan satu set Gambar Bestek /Gambar Revisi dalam format kertas A2, kertas A3 (sementara), satu set Shop Drawing, satu set Spesifikasi Teknis dan satu set Bill of Quantity dilokasi pekerjaan pada setiap kantor lapangan.

2. Gambar Bestek, Gambar Revisi, Shop Drawing, Spesifikasi Teknis, dan Bill of Quantity ditempatkan pada tempat yang baik dan dalam kedaan yang rapi. Pasal 5

: Buku Instruksi dan Buku Tamu 1. Kontraktor Pelaksana harus menyediakan satu buah Buku Instruksi dan Buku Tamu dilokasi pekerjaan pada setiap kantor lapangan dan ditempatkan pada tempat yang baik.

2. Buku Instruksi berisikan instruksi-instruksi dilokasi pekerjaan yang dikeluarkan oleh Konsultan Supervisi dan Owner untuk dilaksanakan oleh Kontraktor Pelaksana yang berhubungan dengan pelaksanaan  pekerjaan. 3. Buku Instruksi harus mencantumkan tanggal instruksi, waktu instruksi, nama dan jabatan yang memberi instruksi, dan tanda tangan yang memberi instruksi. 4. Instruksi Konsultan Supervisi dan Owner yang berada dalam Buku Instruksi harus diketahui dan ditanda tangani oleh Kontraktor Pelaksana minimal Supervisor Lapangan untuk dilaksanakan. 5. Kontraktor Pelaksana juga harus menyediakan buku tamu di kantor lapangan yang diletakan pada tempat yang baik. Semua tamu yang  berkunjung ke lokasi pekerjaan harus terdata dan mengisi buku tamu t amu ang telah disediakan oleh Kontraktor Pelaksana. Pasal 4

: Gambar Hasil Pelaksanaan ( Asbuilt Drawing ) 1. Kontraktor dengan biaya sendiri harus membuat Gambar Hasil Pelaksanaan (Asbuilt Drawing) yang sesuai dengan hasil pelaksanaan  pekerjaan dilapangan sebelum serah terima tahap pertama dilakukan.

4. Kontraktor Pelaksana diwajibkan menyerahkan menyerahkan 5 set As Built Drawing yang telah disetujui kepada Konsultan Supervisi, Owner dan Konsultan Perencana kepada Owner. 5. Satu set As Built Drawing yang telah disetujui harus harus disimpan di di tempat yang baik pada bangunan oleh Owner atau pengguna bangunan. Pasal 5

: Rencana Waktu Pelaksanaan Pelaksanaa n 1. Kontraktor Pelaksana harus mengajukan rencana waktu penyelesaian  pekerjaan (time schedule) keseluruhan kepada Konsultan Manajemen Konstruksi dan Owner sebelum dimulainya pelaksanaan pekerjaan kecuali ditentukan lain dalam Kontrak Kerja.

2. Kontraktor Pelaksana harus menyelesaiankan pekerjaan sesuai dengan rencana waktu penyelesaian pekerjaan keseluruhan yang telah disetujui oleh Konsultan Manajemen Konstruksi dan Owner kecuali ditentukan lain dalam Kontrak Kerja. 3. Kontraktor Pelaksana harus menyerahkan rencana waktu penyelesaian  pekerjaan keseluruhan yang telah disetujui oleh Konsultan Manajemen Konstruksi dan Owner kepada Konsultan Supervisi. 4. Kontraktor Pelaksana juga harus mengajukan rencana waktu  penyelesaian pekerjaan mingguan pada tahap pelaksanaan pekerjaan kepada Konsultan Manajemen Konstruksi dan diketahui oleh Konsultan Supervisi. 5. Konsultan Manajemen Konstruksi berhak untuk tidak menyetujui rencana penyelesaian pekerjaan mingguan yang diajukan oleh Kontraktor Pelaksana dengan memberikan alasan-alasan yang dapat dipertanggung  jawabkan secara teknis. 6. Keterlambatan Kontraktor Pelaksana dalam menyelesaikan pekerjaan karena kesalahan dalam menyusun waktu pemnyelesaian pekerjaan sepenuhnya menjadi tanggung jawab Kontraktor Pelaksana. 7. Keterlambatan Kontraktor Pelaksana dalam menyelesaikan pekerjaan karena factor cuaca seperti hujan yang lebih dari 1 hari kerja dan

8. Keterlambatan Kontraktor Pelaksana dalam menyelesaikan pekerjaan karena factor-factor non teknis yang lebih dari 3 hari kerja dan diketahui oleh Konsultan Supervisi seperti permasalahan dengan tanah/lahan  pekerjaan sehingga Kontraktor pelaksanan tidak bisa memasuki dan memulai pekerjaan, ganguan keamanan dari masyarakat setempat harus diperhitungkan untuk penambahan waktu pelaksanaan pekerjaan. 9. Keterlambatan Kontraktor Pelaksana dalam menyelesaikan pekerjaan karena permasalahan yang berhubungan dengan Spesifikasi Teknis, Gambar Disain, Bill of Quantity dan Kontrak Kerja dimana tidak ada keputusan yang pasti dari Konsultan Manajemen Konstruksi, Konsultan Supervisi, Konsultan Perencana dan Owner lebih dari 3 hari kerja harus diperhitungkan untuk penambahan waktu pelaksanaan pekerjaan. 10. Keterlambatan Kontraktor Pelaksana dalam menyelesaikan pekerjaan yang disebabkan oleh hal-hal selain seperti yang disebutkan dalam point 6, point 7 dan point 8 tidak boleh diperhitungkan untuk penambahan waktu pelaksanaan kecuali ditentukan lain dalam Kontrak Kerja dengan  persetujuan Konsultan Manajemen dan Owner. 11. Lamanya penambahan waktu atau jumlah hari kerja tambahan yang diberikan kepada Kontraktor Pelaksana karena alasan-alasan seperti yang disebutkan pada point 6, point 7 dan point 8 adalah menurut keputusan Konsultan Manajemen Konstruksi dan Owner. Pasal 6

: Request Material Dan Request Pekerjaan 1. Kontraktor Pelaksana harus mengajukan permohonan penggunaan semua material bangunan (request material) sebelum material bangunan tersebut dipakai dan dimasukan kelokasi pekerjaan.

2. Request Material yang diajukan Kontraktor Pelaksana harus disertai dengan contoh material dan disetujui oleh Konsultan Supervisi dan Owner. 3. Persetujuan Request Material yang diajukan diajukan oleh Kontraktor Pelaksana dianggap sah dan diakui apabila disetujui minimal oleh Konsultan Supervisi. 4. Kontraktor Pelaksana harus menyediakan dan dan menyerahkan satu set

: Metode Pelaksanaan Pelaksana an 1. Kontraktor Pelaksana harus mengajukan Metode Pelaksanaan terhadap  pekerjaan Pembesian Plat Lantai, Pengecoran Plat Lantai, Pembesian Poor, Pengecoran Poor, ( Beton Bertulang lainnya ) Konstruksi KudaKuda serta pekerjaan-pekerjaan lain yang memerlukanya.

2. Metode Pelaksanaan yang diajukan oleh Kontraktor Pelaksana harus disetujui oleh Konsultan Supervisi. 3. Pasal 9

: Rencana Tenaga Kerja 1. Kontraktor Pelaksana harus mengajukan rencana pengunaan tenaga kerja mingguan yang akan digunakan untuk penyelesaian pekerjaan setiap minggu kepada Konsultan Supervisi.

2. Semua tenaga kerja sesuai dengan rencana tenaga kerja mingguan yang yang diajukan oleh Kontraktor Pelaksana harus berada dilokasi pekerjaan. 3. Konsultan Supervisi Supervisi berhak untuk tidak menyetujui rencana rencana penggunaan tenaga kerja mingguan yang diajukan oleh Kontraktor Pelaksana dengan memberikan alasan-alasan yang dapat dipertanggung jawabkan secara teknis. Pasal 10

: Pekerjaan Pekerjaan Diluar Jam Kerja 1. Pekerjaan-pekerjaan diluar jam kerja normal yang dilakukan oleh Kontraktor Pelaksana dengan alasan mempercepat proses penyelesaian  pekerjaan harus diketahui oleh Konsultan Supervisi.

2. Biaya-biaya yang harus dikeluarkan oleh personil Konsultan Supervisi untuk pengawasan pekerjaan diluar jam kerja normal yang dilakukan oleh Kontraktor Pelaksana sepenuhnya menjadi tanggung jawab Kontraktor Pelaksana. 3. Kontraktor Pelaksana bertanggung jawab penuh terhadap kualitas  pekerjaan yang dilakukan diluar jam kerja normal atau pada malam hari. Pasal 11

: Laporan Pelaksanaan 1. Kontraktor Pelaksana wajib membuat laporan harian, laporan mingguan, dan laporan bulanan kepada Konsultan Manajemen Konstruksi dan diketahui serta diperiksa oleh Konsultan Supervisi tentang kemajuan  pelaksanaan pekerjaan.

Konsultan

: Surat Menyurat Dan Komunikasi 1. Segala surat-menyurat yang dilakukan oleh Kontraktor Pelaksana yang  berhubungan dengan pelaksanaan pekerjaan yang sifatnya administratif harus melalui dan ditujukan kepada Konsultan Manajemen Konstruksi  juga diketahui oleh Konsultan Supervisi serta Owner.

2. Segala surat-menyurat yang dilakukan oleh Kontraktor Pelaksana yang  berhubungan dengan pelaksanaan pekerjaan yang sifatnya teknis harus melalui dan ditujukan kepada Konsultan Supervisi juga diketahui oleh Konsultan Manajemen Konstruksi serta Owner. 3. Surat menyurat atau perizinan yang berhubungan dengan Instansi lain di luar proyek tidak perlu melalui dan diketahui oleh Konsultan Manajemen Konstruksi. Kontraktor Pelaksana tetap wajib memberikan informasi tentang hal tersebut kepada Konsultan Manajemen Konstruksi. Pasal 13

: Rapat Koordinasi Dan Rapat Lapangan (Site Meeting) 1. Rapat koordinasi diselenggarakan sekurang-kurangnya 1 (satu) kali setiap minggu, dipimpin oleh Owner atau Konsultan supervisi.

2. Kontraktor Pelaksana wajib hadir dalam rapat koordinasi dengan diwakili minimal oleh Site Manager atau Supervisor Lapangan. 3. Kosumsi rapat koordinasi tersebut disiapkan oleh Kontraktor Pelaksana kecuali ditentukan lain oleh Owner. 4. Rapat lapangan (site meeting) diselenggarakan sekurang-kurangnya 1 (satu) kali setiap minggu, dipimpin oleh Owner atau Konsultan supervisi.

2. Jika pekerjaan dilakukan pada tempat-tempat lain yang dilakukan oleh Sub Kontraktor Pelaksana menurut ketentuan dalam Sub Pelaksanaan, maka Kontraktor Pelaksana harus memberikan jaminan agar supaya Owner dan para wakilnya mempunyai wewenang untuk memasuki  bengkel kerja dan tempat-tempat lain kepunyaan Sub Pelaksana  pekerjaan. 3. Owner atau Staf Ahli ( Enggineer ) berhak memberikan instruksi langsung dilapangan kepada Kontraktor Pelaksana dan Konsultan Supervisi untuk suatu perbaikan atau perubahan jika dalam proses  pelaksanaan pekerjaan ditemukan hal-hal yang tidak sesuai dengan Gambar Bestek, Spesifikasi Teknis, Bill of Quantity dan Kontrak Kerja. 4. Owner atau Staf Ahli ( Enggineer ) berhak memerintahkan Konsultan Supervisi secara tertulis untuk menghentikan proses pelaksanaan  pekerjaan yang dilakukan oleh Kontraktor Pelaksana sementara waktu  jika ditemukan hal-hal yang tidak sesuai dengan Gambar Bestek, Spesifikasi Teknis, Bill of Quantity dan Kontrak Kerja. 5. Kontraktor Pelaksana harus menjamin dan bertangung jawab penuh akan keselamatan Owner dan para wakilnya selama berada dilokasi pekerjaan. Pasal 15

: Progress Payment 1. Jika tidak ditentukan lain dalam Kontrak Kerja maka Hasil Pekerjaan Kontraktor Pelaksana di bayar berdasarkan metode Progress Payment. Artinya Tagihan Kontraktor Pelaksana dibayar berdasarkan Progress Realisasi Pekerjaan yang telah diselesaikan dilapangan.

2. Progress Payment Kontraktor Pelaksana diajukan kepada Konsultan Manajemen Konstruksi dan diperiksa kebenaran realisasi pekerjaan dilapangannya oleh Konsultan Supervisi.

Kesalahan pekerjaan dan cacat pekerjaan adalah hasil pemeriksaan  bersama antara Kontraktor Pelaksana, Konsultan Supervisi dan Owner sebelum Serah Terima Tahap Pertama (PHO) dan pekerjaan dinyatakan selesai 100%. 3. Kesalahan pekerjaan dan cacat pekerjaan dari hasil pemeriksaan oleh Pelaksana, Konsultan Supervisi dan Owner dicantumkan dalam sebuah Daftar Pekerjaan Cacat yang ditandatangani oleh ketiga pihak tersebut. 4. Konsultan Manajemen atau Owner harus membuat Berita Acara Hasil Pemeriksaan Pekerjaan untuk ditandatangani oleh Kontraktor Pelaksana, Konsultan Supervisi dan Owner. 5. Semua kesalahan pekerjaan dan cacat pekerjaan yang ada dalam Daftar Pekerjaan Cacat menjadi tanggung jawab Kontraktor Pelaksana memperbaikinya dengan biaya sendiri. 6. Kesalahan-kesalahan dan cacat pekerjaan yang dilakukan oleh Kontraktor Pelaksana dikarenakan kurang memahami Gambar dan kurangnya kontrol terhadap pekerja sepenuhnya menjadi tanggung jawab Kontraktor Pelaksana untuk memperbaiki dengan biaya sendiri. 7. Kesalahan dan cacat pekerjaan yang dilakukan oleh Kontraktor Pelaksana karena lemahnya pengawasan dan kontrol oleh Konsultan Supervisi dan  bukan atas dasar perintah tertulis t ertulis dari Konsultan Supervisi tetap menjadi tanggung jawab Kontraktor Pelaksana untuk memperbaikinya. 8. Kerusakan dan cacat pada bangunan akibat pemakaian atau sebab-sebab

Pasal 17

: Buku Petunjuk Penggunaan Penggunaan Bangunan ( Operation Hand-Book ) 1. Kontraktor Pelaksana bersama dengan Konsultan Perencana harus membuat Buku Petunjuk Penggunaan atau system operasi (Operation Hand-Biook) sebelum masa Serah Terima Pertama untuk semua  peralatan yang ada dalam bangunan seperti : a. Instalasi Listrik;  b. Instalasi Air Bersih dan Air Kotor; dan c. Instalasi Pemadam Kebakaran (jika ada).

2. Operation Hand-Book harus diserahkan kepada Owner dan pengguna  bangunan dengan memberikan memberikan penjelasan yang diperlukan. 3. Operation Hand-Book harus disimpan dengan baik dalam bangunan pada tempat yang ditentukan oleh Owner atau ata u pengguna bangunan. Pasal 18

: Petunjuk Bangunan Dan Nama Ruangan 1. Kontraktor Pelaksana dengan biaya sendiri bersama dengan Konsultan Perencana, Konsultan Supervisi, Owner dan Pemilik Bangunan/Pengguna Bangunan harus membuat petunjuk dan Nama semua ruangan berdasarkan fungsinya masing-masing sebelum masa Serah Terima Pertama (PHO).

2. Kontraktor Pelaksana dengan biaya sendiri bersama dengan Konsultan Perencana, Konsultan Supervisi dan Owner juga harus membuat

Kontraktor pelaksana juga harus menyerahkan Asbuilt Drawing dan Buku Petunjuk Penggunaan Bangunan (Hand Book) yang telah disetujui oleh Konsultan Perencana, Konsultan Supervisi dan Owner sebelum Berita Acara Serah Terima Pertama ditandatangani. 5. Konsultan Supervisi akan mengeluarkan rekomendasi tertulis akan realisasi perbaikan dari semua item dalam Daftar Pekerjaan Cacat dan Asbuilt Drawing yang telah selesai dilaksanakan oleh Kontraktor Pelaksana untuk keperluan penandatanganan Berita Acara Serah Terima Pertama (PHO). 6. Setelah masa pemeliharaan dilampaui dan sesudah semua perbaikan perbaikan dilaksanakan dengan baik, Konsultan Supervisi akan mengeluarkan rekomendasi tertulis mengenai selesainya pekerjaan dan

: Penanggung Jawab Pengawasan 1. Berdasarkan Kontrak Kerja yang dibuat oleh Owner dengan Penyedia Jasa Konsultasi, maka Konsultan Supervisi untuk proyek seperti yang disebutkan dalam BAB I diatas adalah Perusahaan seperti yang disebutkan dalam Kontrak Kerja Konsultan Supervisi.

2. Tugas dan kegiatan Konsultan Supervisi adalah seperti yang disebutkan dalam Keputusan Menteri Permukiman Dan Prasarana Wilayah Nomor : 332/KPTS/M/2002 Tanggal 21 Agustus 2002 Tentang Penyedia Jasa Pengawas Konstruksi atau menurut perubahannya jika ada kecuali ditentukan lain oleh Owner dalam Kontrak Kerja konsultan Supervisi. 3. Konsultan Supervisi harus mengajukan struktur organisasi pengawasan lapangan proyek kepada Konsultan Manajemen Konstruksi dan Owner dimana didalamnya tercantum beberapa tenaga ahli Konsultan Supervisi dengan posisi minimal seperti berikut atau seperti yang diajukan : 1. Site Enggineer/Leader; 2. Chief Inspector; 3. Inspector; 4. Tenaga Administrasi; dan 5. Operator Computer.

Tenaga ahli yang ditempatkan dilokasi pekerjaan oleh Konsultan Supervisi harus mampu memberikan keputusan yang bersifat teknis di lokasi pekerjaan. 10. Konsultan Supervisi harus membuat laporan mingguan dan laporan  bulanan kepada Konsultan Manajemen Konstruksi dan diketahui oleh Owner atas segala hal yang menyangkut pelaksanaan pekerjaan oleh Kontraktor pelaksana. 11. Bentuk, format, dan isi laporan Konsultan Supervisi adalah berdasarkan hasil diskusi dan konsultasi dengan Konsultan Manajemen Konstruksi dan Owner. Pasal 22

: Instruksi Konsultan Supervisi 1. Kontraktor Pelaksana harus mematuhi dan melaksanakan semua instruksi atau perintah yang dikeluarkan oleh Konsultan Supervisi yang  berhubungan dengan pelaksanaan pekerjaan.

e) Perintah untuk melakukan perubahan-perubahan pada metode  pelaksanaan Kontraktor Pelaksana yang dianggap tidak tepat sehingga dapat mengurangi kualitas dan memperlambat proses  penyelesaian pekerjaan. Pasal 23

: Perubahan-Perubahan Perubahan-Perubahan Disain Dan Perbedaan-Perbedaan Perbedaan-Perbedaan 1. Konsultan Perencana dan Konsultan Supervisi dengan persetujuan Konsultan Manajemen Konstruksi serta Owner berhak mengadakan  perubahan-perubahan pada Gambar Bestek, Spesifikasi Teknis dan Bill of Quantity yang wajib dilaksanakan oleh Kontraktor Pelaksana.

2. Kontraktor Pelaksana dengan alasan apapun tidak boleh melakukan  perubahan pada Gambar Bestek, Spesifikasi Teknis dan Bill of Quantity tanpa persetujuan Konsultan Supervisi atau Konsultan Perencana. 3. Perubahan-perubahan akan Gambar Bestek dan Spesifikasi Teknis harus disampaikan secara tertulis kepada Kontraktor Pelaksana untuk dilaksanakan. 4. Perubahan-perubahan pada Gambar Bestek dan Spesifikasi Teknis yang dilakukan oleh Konsultan Supervisi, Konsultan Perencana, dan Owner secara lisan atau tidak tertulis tidak wajib untuk dilaksanakan oleh Kontraktor Pelaksana. Resiko karena melaksanakan Instruksi tidak tertulis sepenuhnya menjadi tanggung jawab Kontraktor Pelaksana.

Konsultan Manajemen Konstruksi dengan persetujuan Konsultan Perencana dan Owner berhak menentukan acuan mana yang harus dipegang bila terjadi perbedaan antara Gambar Bestek, Spesifikasi Teknis, dan Bill of Quantity kecuali ditentukan lain dalam Kontrak Kerja. 10. Kecuali ditentukan lain dalam Kontrak Kerja atau oleh Konsultan Manajemen Konstruksi, jika terjadi perbedaan antara Gambar Bestek, Spesifikasi Teknis dan Bill of Quantity maka urutan acuan yang harus dipegang ditentukan seperti berikut : a) Kontrak Kerja;  b) Bill of Quantity; c) Gambar Bestek dan Gambar Revisi; dan d) Spesifikasi Teknis. Hal-hal yang belum ditentukan dalam Spesifikasi Teknis ini akan ditentukan kemudian oleh Konsultan Manajemen Konstruksi bersama dengan Konsultan Perencana dengan persetujuan Owner dalam proses  pelaksanaan pekerjaan dan menjadi satu ketentuan yang mengikat serta wajib diikuti oleh Kontraktor Pelaksana. 5. Hal-hal yang ditentukan kemudian oleh Konsultan Manajemen Konstruksi tersebut harus tetap mengacu pada Kontrak Kerja yang telah ada. 6. Konsultan Manajemen Konstruksi bersama Konsultan Perencana dengan  persetujuan Owner dapat mengubah sebagian besar atau sebagian kecil
