On pril 22, 1972, Madrigal appealed to the .ivil /ervice .ommission +hich in its 1st 0ndorsement declared the removal o" Madrigal "rom the service illegal On ugust ), 1975, Madrigal sent a letter to the #rovincial oard reuesting implementation o" the resolution o" the .ommission and conseuentl%, reinstatement to his "ormer position *he #rovincial oard, through &esolution No 93, denied Madrigal's reuest "or reinstatement because his "ormer position no longer e4ists On ecember 15, 1975, Madrigal led a petition be"ore the .ourt o" 6irst 0nstance no+ &egional *rial .ourt8 o" Marinduue against public respondents "or mandamus and mandamus  and damages seeing, in inter alia, 18 restoration o" his abolished position in the &oads and ridges 6und 6und udget o" the #rovince: 28 reinstatement reinstatement to such position: and 38 pa%ment o" his bac salaries plus damages  *he trial court court issued an an order dismissing dismissing the petition on the ground that that Madrigal's cause o" action +as barred b% laches. “0t is be%ond uestion that herein petitioner +as separated "rom the service on November 25, 1971, and it +as onl% on ecember 15, 1975, or 6O;& )8
