LEY DE HIGIENE SEGURIDAD OCUPACIONAL OCUPACIONAL Y BIENESTAR R.M. 16998 ART.- 1°.- (Objeto).- La presente ley tiene por objeto: 1) Garantizar la l as co c ondiciones ad a decuadas de d e sa s alud, hi h igiene, seguridad y bienestar en el trabajo. 2) Lograr un un am ambiente de de trtrabajo de desprovisto de de ririesgo pa para la la salud psicofísica de los trabajadores. 3) Proteger a la las pe personas y al al me medio am ambiente en en ge general, contra los riesgos que directa o indirectamente afectan a la salud, seguridad y equilibrio ecológico
ART.- 2°.- Acción del estado, empleador y trabajador.- Los objetivos Señalados se alcanzaran a través de la acción conjunta del estado, Los empleadores y trabajadores la participación de los trabajadores y las organizaciones involucradas es determinante en la ejecución de las normas relativas a las condiciones y medio ambiente de trabajo. DE LAS DEFINICIONES GENERALES Y COMUNES ART.- 4°.- Para los efectos de aplicación de la presente ley, los siguientes términos tienen la significación que se les asigna a continuación Autoridad competente.-Es toda autoridad pública revestida de poderes para dictar reglamentos, órdenes, decretos, otras instrucciones que tenga fuerza de ley con respecto a la seguridad en los Centros de trabajo. Empleador .-Es toda persona natural o jurídica que esté a cargo o tenga a su cargo cargo el cont control rol o vigil vigilanc ancia ia del del trab trabaj ajo o en un centr centro o labo labora rall o de cual cualqu quie ier r empleado del mismo. Trabajador .-Es toda persona que presta servicios a un empleador por el sueldo, Salario Salario u otra remuneración remuneración incluyendo incluyendo cualquier cualquier aprendiz o Discípulo mediante mediante retribución o sin ella . Lugar o centro de trabajo.- Es todo aquel sitio donde el trabajador desenvuelve sus actividades. Seguridad Industrial u Ocupacional .- Es el conjunto conjunto de procedi procedimient mientos os o de naturaleza técnica, legal y administrativa, orientado a la protección del trabajador y los riesgos contra su integridad física y sus consecuencias, así como mantener la continuidad del proceso productivo y la inteligencia patrimonial del centro de trabajo. Inspecc Inspección ión .-es una una funci función ón de natu natural raleza eza técni técnica ca legal legal cuya cuya fina finalilidad dad es contactar el cumplimiento de las disposiciones y normas vigentes. Supervisión.- Es una función técnica administrativa cuya finalidad está orientada a la correcta aplicación de las disposiciones de normas y procedimientos. Riesgo industrial u ocupacional .-Es un estado potencial de origen natural o artificial capaz de producir un accidente de trabajo o enfermedad ocupacional. DEL EMPLEO DE LAS MUJERES Y MENORES DE EDAD ART. 8º. – (PROHIBICIONES) Queda prohibido el trajo de mujeres y menores de 18 años en aquellas labores peligrosas, penosas o nocivas para su salud o que atenten contra su moralidad. – (Código del MENOR: Ley Nº 1403 de 18 de Dic. de 1992) ART. 9º. – (NULIDAD DE CONTRATO). En razón de la naturaleza de orden publico de la prohib prohibici ición ón precede precedente nte es nulo nulo cualqu cualquier ier contra contrato to de trabaj trabajo o suscrit suscrito o contra contra la expresada norma legal, sin perjuicio de que el empleador reconozca los beneficios establecidos por ley.
DE LOS ORGANOS DE EJECUCIÓN Y SUS ATRIBUCIONES ART.- 10° QUIENES EJECUTAN LA PRESENTE LEY: El cumplimiento y ejecución de la presente Ley estará a cargo de los los Ministerios del Trabajo y Desarrollo Laboral y de Previsión Social y Salud Publica, a través del Consejo Nacional de Higiene, Seguridad Ocupacional Y Bienestar, que se crea para el efecto, la Dirección General de Higiene, Seguridad Ocupacional y Bienestar dependiente del Ministerio del Trabajo y Desarrollo Laboral, el Instituto Boliviano de Seguridad Social y el Instituto de Salud Ocupacional.

ART.- 12° El consej consejo o Nacion Nacional al de Higien Higiene, e, Seguri Seguridad dad Ocupac Ocupacion ional al y Bienest Bienestar, ar, determinará de acuerdo a sus necesidades y a las circunstancias, la participación de otros ministerios, entidades, sectores empresariales y laborales que no figuran en el articulo precedente. ART.- 13° CONSTITUCIÓN DEL MINISTERIO DEL TRABAJO Y DESARROLLO LABORA LABORAL: L: el Consej Consejo o Nacion Nacional al de Higien Higiene, e, Seguri Seguridad dad Ocupac Ocupaciona ionall y Bienest Bienestar, ar, funcionará bajo la tuición del Ministerio del Trabajo y Desarrollo Laboral y estará presidido por su Ministro. ART.- 14° SECRETARIA DEL CONSEJO NACIONAL: la Secretaria Permanente del Consejo Nacional de Higiene, Seguridad Ocupacional y Bienestar, será ejercida por la Dirección General de Higiene, Seguridad Ocupacional y Bienestar dependiente del Ministerio del Trabajo y Desarrollo Laboral.
