Reference: Consumer No 490010479085 Letter dated 13/10/2016 13/10/2016.. Subject: Inspection of the electric meter and repair. Under the instructions and authority given by my clients Mr. Ahmed Mushfiq Hasan Siddiqui residing at Plot No 2 Professors colony, N 12/B, Harsool road Delhi Gate Aurangabad Maharashtra. I am here by giving you this legal notice as under:

Brief facts of the case in order to ascertain the real controversy between the parties are as under:-

1)  That, my cl client ient is resi residing ding at the address m mentioned entioned above.  That my client had the residenti residential al house on the above address and has the electricity connection from your company vide consumer no 490010479085. That the said electricity connection is in the name of Late. Mohammed Mushfiq Hasan Siddiqui who was father of my client.

 

  2)  That, Late. Mohammed Mushfiq Hasan Siddiqui was the employee of your company as the Assistant Engineer. That the electricity connection was provided from your company for the residential purpose. That in the month of September, 2016 there was the problem in the meter in respect of fast running. Therefore Late. Mohammed Mushfiq Hasan Siddiqui approached your company in that regard and requested to solve the grievance. Unfortunately there was no positive action from you end therefore my client filed the written complaint in respect of the inspection and the repair of meter on 13/10/2016. But till today there is neither reply given from your company nor any action taken from you. 3)  That my client had deposited deposited Rs. 150/- towards the meter meter inspection on 04/07/2016. Thereafter in the year 2019 on 24/01/2019 the spot inspection was done from your officer and the information was filled as per the inspection which is not disputed. There is also no adverse remark in respect of the meter box, body and thermal cover. However your officer did not mentioned anything as remark. That the spot inspection done by your officer was useless as the meter problem was not yet solved and still my client was being victim of higher bill amount. 4)  That my cli client ent h had ad deposi deposited ted an amount of Rs. 20000/- on 04/07/2016, Rs. 20000/- on 15/02/2017, Rs. 15000/- on 15/05/2017 and Rs. 10000/- on 19/10/2016. That my client had time to time deposited the huge amount for which he was not at all liable to pay legally. That you had always issued the bill at the higher level such as 29360/-

26/01/2017, Rs. 36860/- on 25/08/2016. That the bills issued from you to my client are total arbitrary and baseless. It is pertinent to note that the bills issued from  you are for the residenti residential al purpose therefore the bills generated from you is nothing but the non application of mind. That my client had always shown their bonafinde to pay the bill but unfortunately there is no positive in action from your end. 5)  Therefore you are hereby called upon to repair the meter and thereafter issue the proper bill and recall your previous bills, further inform to your client not to harass my client otherwise my clients will be constrained to initiate civil as well as criminal proceedings against your client before the competent court of law and as a result you client will also be

personally

held

liable

for

the

future

cost

and

consequences. Failing which my clients will be constrained to initiate legal proceedings against your client for recovery of above claimed amount before the competent court of law and as a result you client will also be personally held liable for the future cost and consequences. Your client is also liable to pay Rs 5,000/- towards the legal fees of this notice notice for recovery of amount. 6)  Further you are required to preserve this copy of notice for future legal proceedings. My client kept the Xerox copy of this original notice. Yours truly
