I, Sheryll G. Manalastas, of legal age, married, m arried, and living at Rosario, Santiago City, p etitioner in this case, state under oath as follows: PRELIMINARY STATEMENT

The person examining me is Atty. Fritzgerald Ace S. Palac with address at #5 Marlika Bldg., Centro East, Santiago City. The examination ex amination is being held at the same address. add ress. I am answering his questions fully conscious that I do so under oath and may face criminal c riminal liability for false testimony and perjury.

PURPOSE: This affidavit/testimony of petitioner Sheryll G. Manalastas is being offered to  prove that the respondent John S. Mnalastas is psychologically incapacitated and was unable to comply with essential marital obligations. The petitioner’s testimony is also offered to prove the legal basis legal basis for the declaration of nullity of the petitioner’s petitioner’s marriage with the respondent.

Yes sir. He was the man I married on February 14, 2011.

How did you meet him? I met him when i am working at apple dragon's gym.

Yes sir, I have a marriage contract (Exhibit “A”).

A.

We have one (1) child namely, Mark Manalastas, now 1 year old.

A.

No sir, we are separated from each other.

We are separated since November 13, 2012

What is the reason for your separation?

A.

The respondent’s infidelity, lack of sense responsibility and inability to comply with his marital obligation. He was jobless, a drug addict and did not care to provide the needs of our family, he always hurt me when he go home drunk and when i was not able to give him money for his vices. He was dependent on me.
