INSTRUMENT …CHARGEABLE TO DUTY • Sec. 3 lays down list of all the instruments including bills of exchange which have to be stamped. There is a schedule – which contains list of all such instruments. • No duty is required on government instrument.

Stamp.. • Stamp may be adhesive stamp also. But it must be properly cancelled by the maker of the instrument. Signature or mere cross can also be considered valid, provided it makes the stamp not-usable subsequently.

Mode of cancellation .. • Sec. 12 (3) • Hafiz allah Baksh v/s Dost Mohammad : (1935) if it is possible to reuse stamp, then there is no proper cancellation • Melaram V/s Brij Lal : (1920) diagonal line (extending to the paper) is effective manner of cancellation. • Daya Ram V.s Chandu lal (1925): third party putting a date on stamp is improper cancellation 02/03/09 www.afterschoool.tk
