1. The petition is unjust and not maintainable either in law or on facts. 2.

The petitioner is put to strict proof on all the allegations

made in the affidavit which are not expressly admitted here in by this Respondent. 3.

The

respondent humbly submits that

the

advocate-

commissioner need not be appointed for examining the expert in Nasik. The petitioner has to get court summons to the expert to come to the Honourable court for giving evidence if the petitioner is interested to examine the expert in relation to the opinion given in Ex: B-2. 4.

The responden respondentt humbly submits that he is unable to bear the

expenses for going to Nasik and coming from Nasik since that Nasik is in distant place causing large amount of expenses. The respondent is opposing this application and that the petitioner has to get court summons to the expert at Nasik for giving evidence in the Honourable court, which is convenient to both the parties. There are no merits in this petition. Prayer:   Therefore the respondent prays that Honourable court 5. Prayer: may be pleased to dismiss this petition with costs in the interest of Justice.
