Camarubo-an, Jiabong, Samar; OPINIANO L. LLANITA, Filipino, of legal age, married, residing at Brgy. Camarubo-an, Jiabong, Samar; DANIEL LLANITA DACUMA,  DACUMA,  Filipino, of legal age, single, residing at Brgy. Camarubo-an, Jiabong, Samar and in representation of his deceased mother, CARIDAD L. LLANITA-DACUMA  LLANITA-DACUMA   who Samar; died on ____________ at Brgy. Camarubo-an, Jiabong, JONATHAN PETER LLANITA, Filipino, of legal age, single, residing at Brgy. Camarubo-an, Jiabong, Samar and in representation of his deceased father, PEDRO LLANITA JR. who died on November 8, 2013 at Brgy. Camarubo-an, Jiabong, Samar; and ROLANDO L. LLANITA,  LLANITA,  Filipino, of legal age, single, residing at Brgy. Camarubo-an, Jiabong, Samar;;

WITNESSETH: 1. 

That the above-named parties are the sole heirs of PEDRO of  PEDRO LLANITA, LLANITA, being the the latter’s legitimate legitimate children and grandchildren. grandchildren . (“Heirs of Pedro”) Pedro ”)

PEDRO LLANITA passed LLANITA passed away on February 26, 2000, and at the time of his death, death, was residing residing at Jiabong, Samar, Samar, copy of his death certificate is hereto attached as Annex A;

That the decedent left no will;

4. 

That to the best knowledge and information of the parties hereto, the said deceased left no debts;

5. 

That the said deceased, at the time of his death, owned a parcel of agricultural land, consisting of one-half portion or TEN THOUSAND EIGHT HUNDRED THREE AND 5/100 (10,803.50) SQUARE METERS, more or less, situated at Brgy. Caraubo-an, Jiabong, Samar, covered by Transfer Certificate of Title No. T-3055 issued by the

Registry of Deed for the Province of Samar, Catbalogan City, more particularly described as follows: “A parcel of land (Lot No. 2017 of the Cadastral Survey of Catbalogan), with the improvements thereon, situated in the Municipality of Jiabong. Bounded on the NE. by Lots No. 1635 and 2616; on the SW by Lot No. 2616; and on the NW, by Lot No. 2618. Beginning Beginning at a point marked “1” on plan being S. 10 80”E., 332.02 m. from M.B.M. No. 21; thence S. 24 deg. 52’E., 150.60 m. to point 2; thence S. 6 deg. 41’E., 94.51 m. to point 3; thence N. 65 deg 52’W., 53 deg. 52’W., 247.58 m. to point 4; thence N. 44 deg. 02’E., 02’ E., 111.89 m. to point 5; thence N. 85 deg. 01’ 47.98 m. to the point of beginning; containing an area of Twenty One Thousand Six Hundred Seven (21,607) Square Meters, more or less.”  less.”   6. 

That the above-described parcel of land is not tenanted and does not come within the operation of the Comprehensive Agrarian Reform Program;

That, pursuant to Section 1 of Rule 74 of the Revised Rules of Court of the Philippines, by agreement between the parties herein, the entire interest of the decedent in the above-described property shall be divided and settled among them in equal shares pro indiviso:

That for and in consideration of the sum of FOUR HUNDRED SEVENTY THOUSAND PESOS (P 470,000.00), 470,000.00) , Philippine Currency, receipt of which is herby acknowledged by the HEIRS OF ALEJANDRO [the latter] do hereby SELL, CONVEY, and TRANSFER by way of ABSOLUTE SALE unto  unto  MYLA MARTHA M. CINCO, CINCO, her heirs, assigns and successors-in-interests, all their rights, interests and participation over the above-described parcel of land;
