EXTRA-JUDICIAL DECLARATION OF HEIRSHIP WITH DEED OF ABSOLUTE SALE KNOW LL MEN BY THESE PRESENTS: This agreement is entered into this 25th day of October 2018 at Cebu City, Philippines by and between: 1.  DALISAY CABALSE PALAFOX, Filipino, of legal age, a resident of Sitio Paglaum, Bulacao, Talisay City, Cebu, representing her mother the late ESTRELLA CATAŇARES CABALSE; 2.  LEOPOLDO CASTAŇARES EGUALAN, Filipino, of legal age, single, a resident of Sitio Paglaum, Bulacao, Talisay City, Cebu, representing his deceased mother LUCILA CASTAŇARES EGUALAN; 3.  LOLITA CASTAŇARES LASPOŇA, Filipino, of legal age, married, a resident of Sitio Sto. Nino, Pardo, Cebu; 4.  JULIANA CASTAŇARES LARIOSA, Filipino, of legal age, married, a resident of Sitio Paglaum, Bulacao, Talisay City, Cebu; 5.  DESIDERIA S. CASTAŇARES, Filipino, of legal age, widow, a resident Spolarioum, Duljo, Cebu City; 6.  DARYLL JAMES C. CASTAŇARES, Filipino, of legal age, single, a resident of Magbanua, Argao, Cebu representing his deceased father DARIO S. CASTAŇARES; 7.  MILAGROS CASTAŇARES BUCAO, Filipino, of legal age, widow, a resident of Sto. Nino, Pardo, Cebu City. That we hereby declare that we are the surviving heirs of SUSANA SOTEROL CASTAŇARES who died last 6th of November 2000 at Cebu City, Philippines.

Whereas, our ancestor SUSANA SOTEROL S OTEROL CASTAŇARES died without a will and without obligations or debts in favor of any person or entity. Whereas, SUSANA SOTEROL CASTAŇARES bought a parcel of land from AGUSTINA CASTAŇARES BACLAYON last 6th of December 1999 covering THIRTY TWO (32) SQUARE

METERS located at Barrio Pardo, Cebu City hereto referred as Annex “A” the Deed of Sale of a Portion of a Parcel of Land with more particularly described:

“A parcel of land known as Lot 2 of the consolidation -subdivision plan (LRC) Pcs-6624, being a portion of the consolidation of Lots 5480 and 5480-P, Pcs-62249, LRC Cad. Rec. No. 9467, Case No. 11), situated in the Barrio of Pardo, City of Cebu, Island of Cebu and its boundaries are more specifically described under Transfer Certificate of Title No. 49509, Registry of Deeds for the City of Cebu in the name of Hipolito Baclayon, married to Agustina Cataňares Baclayon.”   Whereas, pursuant to Rule 74 of the Revised Rules of Court of the Philippines, and being in full capacity to contract, we do hereby adjudicate to ourselves the parcel of land described above, in equal shares.

 

FURTHER, FOR AND IN CONSIDERATION OF One Hundred Fifty-Four Thousand Pesos Philippine Currency (Php 154,000.00) , the receipt hereof is hereby acknowledge in full from Spouses Albert Castaňares Bucao and Juvelyn Durango Bucao, both of legal age, Filipino, and a resident of Sto. Hills, Pardo, Cebu City, we do hereby SELL, TRANSFER, CONVEY and DELIVER, by way of ABSOLUTE SALE unto said Spouses Albert Castaňares Bucao and Juvelyn Durango Bucao, their heirs, assigns and successors in interest the property above described with all the improvements existing thereon; That we hereby warrant our valid title to and peaceful possession of the property herein sold and convey and further declares that the same is free from and clear from all liens and encumbrances of any kind whatsoever.
