DEED OF CHATTEL MORTGAGE

KNOW ALL MEN BY THESE PRESENTS:

JACINTO AGUINALDO, of legal age, Filipino, single with residence at #919 Obilivion St., Bellevue Village, Pasig City, hereinafter referred to as the “MORTGAGOR”

AND

TANYA GERERO, of legal age, Filipino, married to FRANCO GERERO with residence at Block 12 Lot 9, Font abello Subdivision, Quezon City, hereinafter referred to as the “MORTGAGEE”,

WITNESSETH that:

The Mortgagor does hereby convey by way of chattel mortgage unto the Mortgagee, the following described personal property, ordinarily situated and presently in the possession of the said Mortgagor, to wit:

That this Chattel Mortgage is given as security for the payment to the Mortgagee, of a certain promissory note, dated August 19, 2011 for the sum of Six Hundred Fifty Thousand Pesos (Php 650,000.00), Philippine Currency, with interest thereon at the rate of 10 per centum (10%) per annum, according to the terms and in the words and figures following:

60 days after date, I, JACINTO AGUINALDO promise to pay, for value received, to TANYA GERERO or order the sum of Three Hundred Fifty Thousand Pesos, with interest at 3 per centum per annum until fully paid. The makers and endorsers severally waive presentment for payment, protest and notice of non-payment of this note.

That the condition of this Chattel Mortgage is such that if the said Mortgagor, his heirs, executors, or administrators shall well and truly perform the full obligation above-stated according to the terms thereof, this Chattel Mortgage shall be discharged and be of no effect, otherwise, it shall remain in full force and effect and shall be enforceable in the manner provided by law.
