3. NationalResponsetoOzoneDepletion The Philippines signed the Montreal Protocol on September 14, 1988 and ratied it on March 21, 1991. The Philippine Ozone Desk (POD) of the Department of Environment and Natural Resources – Environmental ManagementBureau(DENR-EMB)isthenationalcoordinatorofprogramsfor theimplementationoftheMontrealProtocol.Itisalsoknownasthecountry’s NationalOzoneUnit(NOU).
The Philippines’ commitment to the Montreal Protocol is to phase out its consumption of all ODS according to the agreed timetable for Article 5 or developing countries. Article 5 countries are given a grace period of 10 years,whichmeansthatdevelopedcountriesmustphaseoutODSaheadof developingcountries. The Montreal Protocol denes consumption as production plus import minusexport. SincethePhilippines isneithera producernoranexporterof ODS,its consumption is equal to its importation. Aspart of its monitoring and regulatory function, DENR-EMB has been charged with issuance of clearancesofallODSimportations.Theimportofpesticidemethylbromide ismonitored/controlledbytheFertilizerandPesticideAuthority(FPA)ofthe DepartmentofAgriculture(DA).TheBureauofCustomsenforcestheDENR andDAregulationsontheimportandexportofODSbycheckingifimporters have the necessary permits from the DENR or DA to allow entry to the nationalterritory. OtherobligationsofthePhilippinesasaMontrealProtocolPartyinclude: • Article 4 bans imports/exports of ODS between Parties and nonParties (i.e. countries that have not ratied the Protocol or relevant Amendments).TheArticlealsoprovidesforbansonimportsfromnonParties ofproducts made with orcontaining ODS, as decided byMOP. Annex D species a list of products containing CFCs and halons which cannotbeimportedfromnon-Parties. • Article 4A controls trade between Parties, under certain specic circumstances. • Article4BmakesitmandatoryforallPartiestoimplementasystemfor licensingtheimportandexportofODS,forbothnewandusedODS. • Article 7requiresallPartiestoreportODSdatatotheSecretariat onan annualbasis. • Article9requiresPartiestocooperateinpromotingpublicawarenessof the environmental effects of ODS, conduct research and development (R&D) and information exchange on technologies to reduce emissions anddestroyODS,ODSalternatives,andcontrolstrategies. 02

TheRevisedRegulationsontheChemicalControlOrderforODS DENR Administrative Order Number 2013-25, also known as the “Revised Regulations ontheChemicalControlOrderforOzoneDepletingSubstances,” wassignedbytheDENRSecretaryon26December2013andwaspublished for general circulation on10January2014.Thisis the secondrevisionofthe CCO following DAO 2000-18 (Chemical Control Order for Ozone Depleting Substances) DAO 2004-08 (Revised Chemical Control Order for Ozone DepletingSubstances).
TherationaleforupdatingtheCCOincludedthefollowing: • Toupdatethephase-outstatusofcontrolledsubstancescoveredbythe MontrealProtocolonSubstancesthatDepletetheOzoneLayer; • Toreecttheacceleratedphase-outscheduleforhydrochlorouorocarbons (HCFCs)asperDecisionXIX/6oftheNineteenthMeetingofthePartiesto theMontrealProtocol;and • ToprovidethecontinuinglegalbasisforODSphase-out.

ImplicationsoftheRevisedRegulationsontheCCOforODS The revised regulations on the CCO will have implications on the different sectorsthatuseODS,particularlythosethatuseHCFCs,amongothers: ODSImportation Any importer ofODS,excludingimporters of methyl bromide,must register with the Environmental Management Bureau (EMB) of the Department of Environment and Natural Resources (DENR). As before, an importer of ODSmustsecureannuallyacerticateofregistrationfromEMBandaPreShipment Importation Clearance (PSIC) prior to the entry of each ODS shipment within the Philippine territory. Importers must follow updated phase-out schedule for HCFCs and the quota allocation for HCFCs and conform to the “one-shipment, one clearance” policy. Distribution of ODS shallbelimitedtoEMB-registereddealers,resellersandretailersofODS.As of 2010, only HCFCs are allowed to be imported in the Philippines among theODS.OtherODS,includingCFCs,havebeenbannedforimportationby1 January2010. ODSExportationandDestruction The new CCO further regulates the export of controlled substances, in any form, whether alone or in mixtures, including those that are used, stored, reclaimed, recycled, or recovered as well as unwanted ODS. The export of wastes containing ODS shall, however, be governed by the appropriate Department rules and regulations on hazardous waste management and the Basel Convention. Like importers, ODS exporters must secure annually a certicateofregistration from EMB anda Pre-Shipment Export Clearance (PSEC)priortotheexitofeachODSshipmentfromthePhilippineterritory. DistributionofODSintheCountry Only dealers, resellersand retailersof ODS thatare registeredwiththeEMB and accredited by the DTI are allowed to purchase, re-sell, distribute, and utilizeallowableusesofODS.Dealersandretailersshouldalsoadheretothe Code of Practice for Refrigeration and Air-Conditioning (2013 update), and shouldkeeparecordoftheirODSsalesforreferenceduringinspection.Sale ofODSisallowedonlytoserviceshops/providersaccreditedbytheDTIwith aTESDA-certiedtechnician.Saleanduseofsmalldisposablecontainers(less than1kg)withODSisnotpermitted. ServicingofODS-usingEquipment Service providers of ODS-using equipment, such as air-conditioners and refrigeration equipment, must secure a certicate of registration from the DENR to assess their capability to take effective measures, including the necessary equipment, technology, training and infrastructure, for the purpose of effectively handling ODS, including responsible re-use of refrigerants, minimizing theiremissions, and ultimately, phasingout theirusebyreplacing withsubstitutesoralternativesdulyrecognizedandcertiedbytheDENR/EMB. 04
DENR encourages the technicians and mechanics of service providers to obtaincerticationfromTESDAonthenecessaryskillsandcompetencies,and theacquiringofDTIaccreditationtoensuretheavailabilityofnecessarytools andequipmentforenvironmentally-friendlyservicing.Serviceprovidersmust also adhere to the goodpracticesinhandlingandworkingwithrefrigerants set forth in the Code of Practice for Refrigeration and Air-conditioning adopted by the DENR in 2013. From period 2030-2040, an annual HCFC importation of 2.5%of the baselineconsumptionshall beallowedfor usein theservicingsector. FoamManufacturing By 1 January 2015, when HCFC imports shall have been reduced by 10% based on the recorded baseline consumption, all importation ofHCFC-141b andpre-blendedpolyolsforfoam(rigidandexible)manufacturingwillalso be prohibited. Hence, all foam manufacturers are encouraged to shift to alternativetechnologiesinfoammanufacturing. RefrigerationandAir-conditioning By 1 January 2020, when HCFC imports shall have been reduced by 35% based on the recorded baseline consumption, all importation of HCFC22 for the manufacturing of refrigeration and air-conditioning will also be absolutelyprohibited.Hence,companiesareencouragedtoshifttoalternative technologiesinthissectorbefore2020. ChillersandFire-extinguishing By 1 January 2025, when HCFC imports shall have been reduced by 67.5% basedontherecordedbaselineconsumption,allimportationofHCFC-123 as coolingagentforchillersandasreextinguishingagentwillbeprohibited. Hence,companiesareencouragedtoshifttoalternativetechnologiesinthis sectorbefore2025. HCFCBlends By 1 January 2030, when HCFC imports shall have been reduced by 97.5% based on the recorded baseline consumption, all importation of blends containingHCFCswillbeprohibited.Hence,allsectorsthatuseHCFCblends mustshifttoalternativebefore2030.

Section1.BasicPolicy. It is the policy of the State to regulate, restrict or prohibit the importation, manufacture, processing, sale, distribution, use and disposal of chemical substancesandmixturesthatpresentunreasonableriskand/orinjurytohealthor environment.Thispolicyincludestheexportanddestructionofozone-depleting substances to abate or minimize risks and hazards to the stratospheric ozone, publichealth,andtheenvironment. Section2.Objectives. ThisCCOaimsto: 1. Include the legal infrastructure to support the implementation of the Philippine Hydrochlorouorocarbon (HCFC) Phase-out Management Plan (HPMP);and
2. Sustainthephase-outofotherozonedepletingsubstances. Section3.Coverage. 1. This CCO covers the regulation, control, restriction or prohibition of the importation,manufacture,processing,sale,export,distribution,use,disposal, storage, possession anddestruction of chemical substances under Annex A, GroupsI andII; AnnexB,GroupsI,IIandIII;andAnnex C,GroupsIand IIof theMontrealProtocol,asamended,listedinAppendixI. 06
2. Regardless of source, the chemical substances covered by this CCO can be in forms dened under Article I, Paragraph 4 of the Montreal Protocol as clariedunderDecisionI/12AoftheFirstMeetingofthePartiesandDecision II/4oftheSecondMeetingoftheParties,hereinattachedasAppendixII. 3. Ingeneral,thesechemicalsubstancescanexistaloneorinmixtures,canbe contained in bulk for transport and/or storage, as part of a use system or equipment,orusedand/orcontainedinamanufacturedproduct. 4. While considered an ODS, Annex E substance (Methyl Bromide), being a pesticide, is covered by Section 9 of Presidential Decree 1144, Department ofAgriculture AdministrativeOrder No. 17, series of 2010 and Fertilizer and PesticideAuthorityMemorandumCircularNo.01seriesof2011. Section4.DenitionofTerms. ThefollowingtermsasusedinthisCCOshallmeanasfollows: 1. Alternativesubstance A replacement of ODS with zero Ozone Depleting Potential (ODP), such as hydrouorocarbons(HFCs). 2. Article5country A developing country that is a party to the Montreal Protocol and whose annual calculated consumption of controlled substances is less than 0.3 kilogramspercapita.SuchcountryisconsideredtooperateunderArticle5of theMontrealProtocol. 3. Backconversion Theactofcharging withchlorouorocarbon(CFC)orhydrochlorouorocarbon (HCFC)asystemdesignedforand/orusingnon-CFCornon-HCFC. 4. BaselineconsumptionofHCFC TheaverageconsumptionofHCFCinODPtonnesfor2009-2010. 5. BlendedODS AcombinationormixtureofODSandotherchemicalsubstances. 6. Bureau TheEnvironmentalManagementBureau. 7. ChlorouorocarbonsorCFCs Thefamilyofchemicalsthatcontainschlorine,uorineandcarbon.CFCsare oftenusedasrefrigerants,aerosolpropellants,cleaningsolvents,andblowing agents(i.e.,inthemanufactureoffoam).

8. Consumption The sum of production and imports minus exports of ODS. The amount recycled and reused is not considered as production. Since the Philippines doesnotproducenorexportODS,thecountry’sconsumptionisequivalentto importsasmeasuredbyODPweight. 9. Controlledsubstance Any chemical that is subject to control measures, such as a phase-out requirementpursuanttothescheduleoftheMontrealProtocolonSubstances thatDepletetheOzoneLayer,asamended. 10. Dealer Any person that buys ODS, ODS-containing equipment or ODS-containing productinanyforminordertoselltheseforbusinessorcommercialpurposes. 11. Department TheDepartmentofEnvironmentandNaturalResources. 12. Destruction The removal or obliteration of unwanted ODS with an efciency of 99.9% or higher using technologies approved for destruction of concentrated sources (largely refrigerants) and for dilute sources (foams containing ODS). Destruction technologies may include cement kilns, argon and nitrogen plasma,andgaseousorfumeoxidation.Thefulllistofapprovedtechnologies was updated at the 23rd Meeting of the Parties through Decision XXIII/12 (Bali 2011). It also refers to a process which, when applied to controlled substances,resultsinthepermanenttransformationordecompositionofallor asignicantportionofsuchsubstances. 13. DisposalofODS Thecollection,sorting,transport,storage,andtreatmentofunwantedODS. 14. Essentialuse TheuseofODSthatisexemptfromphase-outandothercontrolmeasures. Exempted use of controlled substances does not count towards a country’s consumption. A global exemption has been granted for laboratory and analytical uses. Countries may request essential use exemptions on behalf ofindividualenterprisesifthespecicODSiseitherforhealth,safetyorfor functioning of society where no acceptable alternative is available. The MeetingofthePartiesdecidesonsuchrequestsonacase-by-casebasis. 15. Exporter Any person that undertakes to bring outside of the country an equipment, substance, or product, in any form, including those that are used, stored, restoredorrecovered,whichisintendedfordirectconsumption,warehousing, sale,ordistributioninanothercountry.Thetermalsoincludesapersonwho bringsoutsidethecountryanyunwantedODSorwastescontainingODS. 08
16. Flushing The act ofcleaning a contaminatedrefrigeration or air conditioningsystem orasystemwithaburntcompressorbypumpingorblowinggas,mediumor solventthroughthesystem,thenreleasingthecompoundstotheatmosphere ortoasystemincontactwiththeatmosphere. 17. HydrochlorouorocarbonsorHCFCs The family of hydrogenated chemicals related to CFCs which contain hydrogenaswellaschlorine,uorine,andcarbon.Thehydrogenreducestheir atmosphericlifetime,makingHCFCslessozone-depletingthanCFCsandthus consideredastransitionalsubstances. 18. PhilippineHCFCPhase-outManagementPlanorHPMP The overarching strategy and investment projects aimed to phase out the useofHCFCsinthefollowingsectorsinthePhilippines:foam,airconditioning and refrigeration, re extinguishing and chillers, and servicing sectors. ImplementationofthePhilippineHPMPissupportedbytheMultilateralFund (MLF)oftheMontrealProtocolonSubstancesthatDepletetheOzoneLayer and its Implementing Agencies such as the United Nations Development Programme(UNDP),UnitedNationsEnvironmentProgramme(UNEP),United NationsIndustrialDevelopmentOrganization(UNIDO),andtheWorldBank. 19. Importer Anypersonthatundertakestheentryofanequipment,substanceorproduct intothecountrythatisintendedfordirectconsumption,warehousing,sale,or distribution. 20. Installation Anypermanentmountingorsetting-upofasystem,ortransferofequipment from one location to another, which involves opening the system to the atmosphere, such as when the piping has to be cut and reconnected, or involvingxedinstallationtowaterpipingorelectricity. 21. Methylbromide An ozone-depleting substance that covers a broad spectrum of pesticides registeredwiththeFertilizerandPesticideAuthorityforuseasspaceandsoil fumigantforthecontrolofweeds,nematodes,fungi,andinsectpests. 22. MontrealProtocolonSubstancesthatDeplete theOzoneLayerorMontrealProtocol The Protocol to the Vienna Convention, signed in 1987 and subsequently adjusted or amended, which commits Parties to take concrete measures toprotecttheozonelayerbyfreezing,reducing,orendingproductionand consumptionofcontrolledsubstances.

23. Ozone A gas whose molecules contain three atoms of oxygen, and whose presence in the stratosphere constitutes the ozone layer that protects life against harmful radiation. Ozone is toxic to humans, animals, and plants athighconcentrations.Itisapollutantwhenitoccursinsmoginthelower atmosphere. 24. Ozonedepletion The process by which the stratospheric ozone is destroyed by man-made chemicals,leadingtoareductioninitsconcentration. 25. Ozone-depletingpotentialorODP A measure of the ability of a substance to destroy the stratospheric ozone basedonitsatmosphericlifetime,stability,reactivity,andcontentofelements thatcanattacktheozone,suchaschlorineandbromide.AllODPsarebased onthereferencemeasureof1forCFC-11andCFC-12. 26. ODPTonne(equaltoMetricTonnexODP Ameasurementoftheozonedepletingpotentialweightofasubstance. 27. Ozone-DepletingSubstanceorODS Any substance which is controlled under the Montreal Protocol and its amendments.ODSincludesCFCs,HCFCs,halons,carbontetrachloride,methyl chloroform, hydrobromouorocarbons, bromochloromethane, and methyl bromide.ODShasanozone-depletingpotentialgreaterthanzero(0)andcan depletethestratosphericozonelayer. 28. Ozonelayer A thin, fragile shield created as ozone forms and breaks down in the stratosphere.Thisozonelayerenvelopestheentireearthwhichefcientlyand effectivelyltersandscreensmostoftheharmfulultraviolet(UV)rayslikeUV-B. 29. Party A country that signs and/or raties the Montreal Protocol and its relevant adjustmentsoramendmentsindicatingthatitagreestobeboundbytherules setouttherein.Article4oftheMontrealProtocolrestrictstradewithcountries thatarenotpartiestotheProtocol. 30. Person A natural or juridical entity. A person may be an individual, a corporation, partnership,orassociation. 31. Phase-out The ceasing of the production and consumption of a chemical substance controlled under the Montreal Protocol other than those considered for essentialuses. 10

Recycle The act of reducing contaminants in used refrigerants by separating oil, removing condensables, and using devices, such as lter dryers to reduce moisture,acidity,andparticulatematter. 33. Re-seller Anypersonwhoisengagedinthebusinessofbuyinganequipment,product, orsubstanceinanyformfromadealeroranoriginalsellerforthepurposeof sellingittoanother. 34. Retailer Any person who sells an equipment, product, or substance in any form directlytoaconsumerorenduser. 35. R-502 Ablendofrefrigerantcomposedof51.2%CFC-115and48.8%HCFC-22.Thisis commonlyusedforlowtemperaturerefrigerationsystems. 36. Serviceprovider Any person engaged in the business of or who directly performs the installation,maintenance,service,repairoroperationofODS-usingequipment located on any land or water body. Service providers may be technicians, mechanics,contractors,serviceshops,andrepairshops. 37. Servicing Anyactofrepair,maintenance,testing,ortrouble-shootingofparts,including mechanical and electrical component, of existing ODS-using equipment locatedonanylandorwaterbody. 38. Venting Thepracticeofintentionallyreleasingand/orpurgingODStotheatmosphere. Section5.BanonImportationofODS. ThisCCOafrmsthepreviousbanonimportation,exceptforessentialuses,inany amount,ofthefollowingsubstances,whetheraloneorinmixtures,asprovided under the Department’s Notice to the Public dated December 1998, relevant administrativeorders,andlistedinAppendixIofthisCCO: 1. AnnexEGroupI:Non-QPSMethylBromidesince01January2009. Notwithstanding the above provisions, the importation of CFC-11, regardless of sector or purpose, is absolutely banned since 01 January 2005. Further, importationofallCFCs,includingthoseinR-502,regardlessofsectororpurpose, isabsolutelybannedsince01January2010. Section6.Phase-OutScheduleandControlofImportationofODS. 1. ForAnnexCGroup1(HCFCs): a. By01January2013,importsshallnotexceedtherecordedbaseline consumptioninODPtonnes.
b.
By01January2015,importsshallhavebeenreducedby10%basedon therecordedbaselineconsumptioninODPtonnes. By this date,all importationofHCFC-141b and pre-blendedpolyols for foam(rigidandexible)manufacturingwillalsobeabsolutelyprohibited, exceptfortheservicingandsolventsectors.
c.
By01January2020,importsshallhavebeenreducedby35%basedon the recordedbaselineconsumptioninODPtonnes. By this date, all importation of HCFC-22 for the manufacturing of refrigeration and air-conditioning will also be absolutely prohibited, exceptfortheservicingsector.
d.
By01January2025,importsshallhavebeenreducedby67.5%basedon therecordedbaselineconsumptioninODPtonnes. Bythisdate,allimportationofHCFC-123ascoolingagentforchillersand asre extinguishingagentwill likewisebeabsolutely prohibited,except fortheservicingsector.

e.
By01January2030,importsshallhavebeenreducedby97.5%basedon therecordedbaselineconsumptioninODPtonnes. Bythisdate, all importationof blendscontainingHCFCs willlikewisebe absolutelyprohibited.
f.
By01January2040,importationshallhavebeenabsolutelyprohibited. By this date, all kinds of importation of HCFC substances for the manufacturing and servicing sectors, except for essential use, will be prohibited.
h.
However,duringtheperiod2030-2040,anannualimportationof2.5%of thebaselineconsumptionshallbeallowedfortheservicingsector.
2. Consistent with Section 6.1.a-6.1.g of this CCO, an annual import quota allocation system shall be implemented by the Department through the Bureau. 3. The annual import quota is non-cumulative, that is, any remainder of the quotaallocationforaparticularsubstanceisdeemedconsumedattheend ofthecalendaryear.Thetotalannualimportsshallbeinaccordancewiththe phase-outscheduleoutlinedinSection6.1.a-6.1.gofthisCCO. 4. TheDepartment,throughtheBureau,mayacceleratethephase-outschedule fortheservicingsectorasitmaydeemnecessary,throughtheissuanceofan appropriatepolicyinstrument. Section7.RegistrationandRenewalofRegistrationofImportersofODS. 1. Any person who imports ODS (regardless of source as allowed under the agreementsoftheMontrealProtocol,asamended)foranyindustryoractivity, such as those listed under Appendix IV, must register with the Department throughtheBureau.
2. ACerticateofRegistrationissuedbytheDepartmentthroughtheBureauis validonlyforthecalendaryearwhenitwasobtained.Anapplicationforthe renewal of registrationforevery succeedingperiod priorto any importation mustbesubmittedwithinthelastthirty(30)daysofthecurrentcalendaryear. 3. ACerticateofRegistrationmaybegrantedandrenewedonlyuponshowing proofofthefollowing:

Understanding and appreciation of the role of ODS in depleting the stratospheric ozone and its consequences, as well as capability to take effective measures, including the necessary equipment, technology, trainingandinfrastructure,for the purpose ofeffectivelyhandlingODS, including responsible reuse of refrigerants, minimizing their emissions, andultimatelyphasingouttheirusebyreplacingthemwithsubstitutesor alternativesdulyrecognizedandcertiedbytheDepartmentthroughthe Bureau, as shown by proof of attendance or certicate of participation bytheapplicantrm’schemicalhandlerinatleastonerelevanttraining/ seminar organized within the last three (3) years from the date of applicationbyanyofthefollowingentities: i. Department/Bureau; ii.
TechnicalEducationandSkillsDevelopmentAuthority(TESDA)and TESDA-accreditedtraininginstitutions;
iii.
Industryin-houseseminarsandhands-ontraining;or
iv.
Internationally-recognizedorforeign-basedtraininginstitutions.
Compliance with Section 8 (Pre-Manufacturing and Pre-Importation Notication or PM-PIN requirements) of Republic Act No. 6969; and Section 14 (Chemical Substances Inventory), Section 15 (PM-PIN), and Section17(NoticationofNewChemicals)ofDENRAdministrativeOrder No.29,seriesof 1992 (ImplementingRules andRegulationsofRepublic Act No. 6969); and otherpertinent environmentallaws andregulations, suchasthePhilippineEnvironmentalImpactStatement(EIS)system.
4. The application for registration, includingitsrenewal, must beaccompanied bythefollowingdocuments: a. Dulyaccomplishedandnotarizedregistrationform;

Photocopy of the Environmental Compliance Certicate (ECC) or CerticateofNon-Coverage(CNC)issuedbytheappropriateofceofthe Department;
c.
PhotocopyofregistrationwiththeSecuritiesandExchangeCommission (SEC), Cooperatives Development Authority (CDA), or Department of TradeandIndustry(DTI),withanupdatedlistofitsofcers;
d.
Photocopy of the Material Safety Data Sheet (MSDS) from the manufacturingrmeverytimeanimporterappliesforregistrationofa newchemical;
e.
Document describing the applicant's handling procedure, safety precautions,andemergencyresponseforthechemical;and
f.
Other pertinent documents or information as may be required by the DepartmentandtheBureau.
5. Notwithstanding the foregoing provisions, the Department through the Bureau may, atitsoption and when circumstances warrant, conduct further vericationoftheapplicant’scapabilityasanimporterbeforetheissuanceor renewalofsuchregistration. 6. ForanimportationcoveredbySection6hereof,theDepartmentthroughthe Bureaushall,uponevaluationoftheapplication,determinetheannualquota persubstanceforeveryimporter. Section8.Pre-ShipmentImportationClearance(PSIC)forODS. 1. Registered importers must secure a Pre-Shipment Importation Clearance (PSIC) from the Department through the Bureau prior to the entry of ODS listedinSection3andAppendixI(AnnexC)ofthisAdministrativeOrderin anyareawithinthePhilippineterritory.Anyshipmentnotcoveredbysuch importation clearance shall be deemed to have been illegally imported, in which case, the same shall be conscated and forfeited in favor of the government. Likewise, any transaction not covered by the terms and conditionsofthesaidPSICshallbeconsideredaviolationofthisCCO.
2. ApplicantsforaPSICmustobservethefollowing: a. TheapplicationforimportationclearanceforsubstancesunderSection3 ofthisCCOmustbewithintheprescribedquotapursuanttoSection7.6 ofthisCCO; b.
In order for applications to be considered as received for processing, an applicant must duly accomplish the application form and pay the correspondingprescribedfeesandcharges;and
c.
Applicationformsshallbeaccomplishedinthree(3)copiesandledwith theDepartmentthroughtheBureauforassessmentandevaluation.
3. ThefollowinginformationmustbeprovidedintheapplicationforaPSIC: a. Commercial name, trade name, or brand name of the substance as usuallypromotedormarketedbythemanufacturers; b.
Genericnameofthesubstance;
c.
Nameandaddressofthemanufacturingcompany;
d.
Portofloadingorthecountryorportimmediatelybeforethesubstance entersthePhilippineterritory; 15
e.
Exportingcompany oranyentitythattransactsorbrokersthe chemical substancefromthemanufacturertotheimportingcompany;and
f.
Currentinventoriesofthesubstancethatisthesubjectoftheapplication forimportationclearance,includingtheareaorbuildingwithinwhichthe sameisstoredeitherforfurthertransshipmentordistribution.
4. Allaccomplishedapplicationformsmustalsoincludethefollowingdocuments: a. Ofcialreceiptshowingthattheprescribedapplicationfeesandcharges havebeenpaid; b.
Photocopyofthepro-formainvoice;
c.
Photocopy of the accomplished Record of Actual Arrival of Shipment accompaniedbyaphotocopyoftheBillofLadingissuedbythecarrier (shippingortransportcontractor)ofthemostrecentimportationofthe chemicalmadebytheapplicant.However,thisprovisiondoesnotapply toneworrst-timeimporters;
d.
Asummaryofthetransactionsmadeunderthemostrecentimportation clearance issued on the same chemical applied for. However, this provisiondoesnotapplytoneworrst-timeimporters;
e.
ImportEntryandInternalRevenueDeclaration;
f.
Listofintendedbuyersand/orend-users;and
g.
AnyotherpertinentdocumentsthattheDepartmentandtheBureaumay deemappropriateandnecessary.
5. Importers shall distribute these substances only to registered/accredited dealers, retailers, re-sellers, service providers and service shops pursuant to Sections 9 and 10 hereof or to those entities utilizing these substances for essentialusesascertiedbytheDepartmentthroughtheBureau. 6. ThePSICshallonlybeissuedonapersubstancepershipmentbasis. 7. The PSIC shall be issued in three copies, one each for the Department, the BureauofCustoms,andtheimporter. 8. The PSIC shall only be valid within the same calendar year of the date of issuance. Applicants are thus encouraged to submit their respective applicationsfor renewal and accompanying documents within the last thirty (30)daysofthecurrentcalendaryear.

Section9.RegistrationandRenewalofRegistrationofDealers,Retailers, andRe-sellersofODS. 1. ConsistentwiththeDepartment’sMemorandumCircularNo.2005-23onthe Registration of Dealers, Re-sellers, and Retailers of ODS, any person who is engagedintrading,selling,and/ordistributionofODS(regardlessofsourceas allowedundertheagreementsoftheMontrealProtocol,asamended)forany industryoractivity,suchasthoselistedunderAppendixIV,mustrstregister with the Department through the concerned Regional Ofce of the Bureau inordertodeterminetheircapabilityinhandlingandusingthesesubstances. Such registration is on an enterprise and site-specic basis, and not on a chemicalbasis.
2. A Certicate of Registration may be granted and renewed only when the applicantshowsproofofthefollowing: Understanding and appreciation of the role of ODS in depleting the stratosphericozoneanditsconsequences,aswellascapabilitytotakeeffective measures, including the necessary equipment, technology, training and infrastructure,forthepurposeofeffectivelyhandlingODSincludingresponsible reuse of refrigerants, minimizing their emissions, and ultimately phasing out their use by replacing them with substitutes or alternatives duly recognized and certied by the Department through the Bureau, as shown by proof of attendance or certicate of participation by the applicant rm’s chemical handler inatleastone relevanttraining/seminarorganized within the last ve (5)yearsfromthedateofapplicationbyanyofthefollowingentities: a. Department/Bureau; b.
Technical Education and Skills Development Authority (TESDA) and TESDA-accreditedtraininginstitutions;
c.
Industryin-houseseminarsandhands-ontraining;or
d.
Internationally-recognizedorforeign-basedtraininginstitutions.
Such training must include an orientation on the preservation of the ozone layer, the provisions of this CCO, and training on handling chemicals from suppliers(includingrellingactivities). 3. The application for registration, includingitsrenewal, must beaccompanied bythefollowingdocuments: a. Dulyaccomplishedandnotarizedregistrationform; b.
PhotocopyofregistrationwiththeSecuritiesandExchangeCommission (SEC), Cooperatives Development Authority (CDA), or Department of Trade and Industry (DTI), or local government permits and clearances, andupdatedlistofitsofcers;and 17
c.
Copyofthedispositionreportofthepreviousyear.
4. ACerticateofRegistration issuedby the Departmentthroughthe Regional OfcesoftheBureauisvalidonlyforthecalendaryearwhenitwasobtained. Applicants are thus encouraged to submit their respective applications for renewalandaccompanyingdocumentswithinthelastthirty(30)daysofthe currentcalendaryear. 5. Only dealers, retailers, and re-sellers registered by the Department through theRegionalOfcesoftheBureaumaypurchase,re-sell,anddistributethe ODSlistedunderSection3forallowableusesinAppendixIV.TheODSmay onlybesoldordistributedtoserviceprovidersthataredulyregisteredunder Section10ofthisCCO. Section10. RegistrationandRenewalofRegistrationof Service Providers ofODS-usingEquipment. 1. ServiceprovidersofODS-usingequipmentmustregisterwiththeDepartment through the Bureau to determine their capability in handling and working on these substances. However, a Certicate of Registration may only be granted by the Department upon showing proof that the service provider hasbeendulycertiedbyTESDAinthecaseofindividualmechanicsorthose accreditedbyDTIinthecaseofservice/repairshops.
2. Service providers should have the capability to take effective measures, including the necessary equipment, technology, training and infrastructure, forthepurposeofeffectivelyhandlingODS,includingresponsiblere-useof refrigerants,minimizingtheiremissions,andultimatelyphasingouttheiruse byreplacingwithsubstitutesoralternativesdulyrecognizedandcertiedby theDepartmentthroughtheBureau. 3. Serviceprovidersshalladheretothegoodpracticesinhandlingandworking with refrigerants set forth in the Code of Practice for Refrigeration and AirconditioningapprovedandadoptedbytheDepartmentin2013. 4. Serviceprovidersshallalsoparticipateinasystemtorecover,reclaim,andreuserefrigerantsthatwillbeledbytheDepartment. 5. A Certicate of Registration issued by the Department through the Bureau isvalidforaperiodofthree(3)years.Applicationsforrenewalmaythusbe submittedwithinthelastthirty(30)daysofthethirdcalendaryear.

Section11.RegulationoftheExportofODS. 1. This CCO further regulates the export of controlled substances, in any form, whether alone orin mixtures, includingthose that are used, stored, reclaimed, recycled,orrecoveredaswellasunwantedODS.Theexportofwastescontaining ODS shall, however, be governed by the appropriate Department rules and regulationsonhazardouswastemanagementandtheBaselConvention.

TheexportofODSshallbesubjecttolicensing,inwhichcaseanexportlicense shall be issued by the Department through the Bureau after verication of compliancewiththerequirementsforexport.
3. TheexportofODStoanycountrythatisnotapartytotheMontrealProtocol anditsamendmentsisprohibited. Section12.RegistrationandRenewalofRegistrationofExportersofODS. 1. Section13.Pre-ShipmentExportClearance(PSEC). 1. Registered exporters must secure a Pre-Shipment Export Clearance (PSEC) from the Department through the Bureau prior to the exit of ODS listed in Section 3 from the Philippine territory. Any shipment not covered by such PSEC shall be deemed to have been illegally exported. Likewise, any transaction not covered by the terms and conditions of the said PSEC clearanceshallbeconsideredaviolationofthisCCO.
2. ApplicantsofPSECmustobservethefollowing: a. In order for applications to be considered as received for processing, an applicant must duly accomplish the application form and pay the prescribedfeesandcharges;and b.
Applicationformsshallbeaccomplishedinthree(3)copiesandledwith theDepartmentthroughtheBureau.
3. ThefollowinginformationmustbeprovidedintheapplicationforaPSEC: a. Commercial name, trade name, or brand name of the substance as usuallypromotedormarketedbythemanufacturers;

Genericnameofthesubstance;
c.
Nameofthemanufacturingcompany;
d.
Portofentryofreceivingcountry;and
e.
Importingcompanyorany entitythattransactsor brokersthe chemical substancefromthemanufacturertotheexportingcompany.
4. All accomplished application forms must also include the following documents: a. Ofcialreceiptshowingthattheprescribedapplicationfeesandcharges havebeenpaid; b.
Photocopy of the Material Safety Data Sheet (MSDS) from the manufacturingrmeverytimeanexporterappliesforclearanceofanew chemical,whenapplicable;
c.
Photocopyofthepurchaseorderoritsequivalent;
d.
Document describing the applicant’s handling procedure, safety precautions,andemergencyresponseforthechemical;and
e.
Photocopy of the Bill of Lading issued by the carrier (shipping or transportcontractor).
5. ThePSECshallonlybeissuedonapersubstancepershipmentbasis. 6. The PSEC shall beissued in three copies, one each forthe Department,the BureauofCustoms,andtheexporter. 7. ThePSECshallbevalidforaperiodnotexceedingone(1)calendaryearfrom thedateofissuance. Section14.RecordsKeeping. All importers, exporters, dealers, retailers, and re-sellers must keep a record of alltransactionsandprepareanannualreport,whichmustbesubmittedtothe Bureaubythe31stofJanuaryofthefollowingyear.Theannualreportshallbe preparedaccordingtoformatsprescribedbytheBureau.
All service providers shall likewise keep a record of all transactions, including quantityofrecoveredrefrigerants,forpurposesofvalidationbytheBureau. Recordsretainedbyimporters,exporters,dealers,retailers,andre-sellersmustbe availableforinspectionatanytimebyanauthorizedofceroftheDepartment throughtheBureau.

Section 15. Public Access to Records and Condentiality of Business Information. ThereportsreceivedbytheDepartmentorBureaushallbeconsideredaspublic documents. As such, the public shall have access to these records, reports or informationconcerningchemicalsubstancesandmixtures,includingsafetydata submitted,dataonemissionordischargeintotheenvironment.Suchdocuments shall be available for inspection or reproduction during normal business hours, except when the report, in full or part thereof, is claimed or regarded as condential pursuant to Sections 40(1) and40(2) of DENRAdministrativeOrder No. 29, series of 1992, in which case disclosure of information may only be allowedincasesunderSection40(3)thereof. Section16.Capability-BuildingProgram. InordertosupporttheimplementationoftheHCFCphase-outandpromotethe useofalternativesubstances,theDepartmentthroughtheBureaushallformulate a capability-building program that will increase research aswell asinformation, education,andcommunication(IEC)effortsonthisCCO. Section17.AdministrativeViolations. InadditiontotherelevantprovisionsofRepublicActNo.6969,RepublicActNo. 8749, DENR Administrative Order No. 29, series of 1992, and other violations arisingfromtheimplementationofSections4-15ofthisCCO,thefollowingacts andomissionsshallbeconsideredasadministrativeviolations: 1. Backconversion;
2. InstallationofCFC-usingsystem; 3. Saleanduseofsmalldisposablecontainers(lessthan1kg)withCFCs; 4. Importation or manufacturing or placing in the market of products or equipmentcontainingHalonsorCFCs; 5. Use of CFC-containing equipment in mobile transportation starting in 2012 pursuanttotheDOTC-DENRJointAdministrativeOrderNo.03,seriesof2006 or the “Enforcement of Regulation on the Implementation of the NCPP on MotorVehicles”undertheRevisedChemicalControlOrder(CCO)forOzone Depleting Substances (ODS) (DENR Administrative Order No. 08, series of 2004); 6. UseofCFC-11asblowingagentforfoammanufacturing; 7. IntentionalreleaseorventingofODS; 8. UseofCFC-11andotherbannedODSasushingorcleaningagent;and 9. Possessionofunregisteredrefrigerants,includingmislabelingofcontrolled substances. 22
Section18.PenalProvisions InadditiontotherelevantprovisionsofRepublicActNo.6969,RepublicActNo. 8749, DENR Administrative Order No. 29, series of 1992, and other violations arisingfromtheimplementationofSections4-15ofthisCCO,thefollowingacts andomissionsshallbeconsideredasadministrativeviolations: 1. Cancel the registration of importers, exporters, dealers, retailers, and resellers;
2. Recommend the cancellation of the DTI accreditation of service or repair shops,and; 3. Recommend the cancellation of the TESDA certicates of competency of technicians,mechanics,contractors,andotherserviceproviders. The foregoing administrative and penal provisions shall not prevent the Department through the Bureau from issuing interim orders to stop the continuedcommissionofthepertinentviolation. Section19.SeparabilityClause. If any part or section of this CCO is declared unconstitutional or invalid by a competent court, the other provisions hereofshall continue to be in force and effectasifthepartorsectionsodeclaredunconstitutionalorinvalidhadnever beenincorporatedherein. Section20.RepealingClause. DENRAdministrativeOrderNos.2004-08orthe“RevisedChemicalControlOrder for Ozone Depleting Substances (ODS)”, 2002-22 or the “Deletion of Footnote No.3ofDENRAdministrativeOrderNo.2000-18”,and2000-18orthe“Chemical Control Order for Ozone Depleting Substances (ODS)” are hereby repealed. All other Department orders and issuances inconsistent herewith are hereby amendedormodiedaccordingly. Section21.Effectivity. ThisCCOshalltakeeffectfteen(15)daysafteritspublicationinanewspaperof generalcirculationanduponacknowledgmentofreceiptofacopyhereofbythe OfceoftheNationalAdministrativeRegister(ONAR).

APPENDIXII DecisionsonControlledSubstances Decision1/12A:Claricationoftermsanddenitions: Controlledsubstances(inbulk) TheFirstMeetingofthePartiesdecidedinDec.1/12Atoagreetothefollowing clarication of the denition of controlled substances (in bulk) in Article I, paragraph4oftheMontrealProtocol: 1. ArticleIoftheMontrealProtocolexcludesfromconsiderationasa"controlled substance"anylistedsubstance,whetheraloneorinamixture,whichisina manufactured product other than a container used for transportation or storage;
2. Any amount of acontrolled substanceoramixtureof controlled substances which is not part of use system containing the substance is a controlled substanceforthepurposeoftheProtocol(i.e.abulkchemical); 3. If a substance or mixture must rst betransferredfrom a bulk container to anothercontainer,vesselorpieceofequipmentinordertorealizeitsintended use,therstcontainerisinfactutilizedonlyforstorageand/ortransport,and thesubstanceormixturesopackagediscoveredbyArticleI,paragraph4of theProtocol; 4. If, on another hand, the mere dispensing of the product from container constitutesthe intendeduseofthe substance, thenthatcontainer isin itself part of use system and the substance contained in it is therefore excluded fromdenition; 27
