AQUINO III President Republic of the Philippines Re: BACK-PAYS/PENSION FUND FOR ELDERLY PILIPINOS His Excellency, We want to inform the Office of the President regarding available funds not coming from Tax-Payer Money that can be availed to help our Qualified Beneficiaries the Elderly Filipinos that were born on or before the end of World War I- 1918, World War II-1945 and Senior Citizen. The available fund is part our Loan Fund Project Program to be availed from the World War I and World War II Reparation Commission. Funds were already transferred here in the Philippine Bank/s Back-Pays/Pension Fund will be part of our total loan to be availed to finance the Philippine Economic Environmental Social Spiritual (PEESS) Projects through the implementation nationwide of the prepared “Forever Green Project Program” and attached projects In that regards we are proposing creation of the Specialized Agency called War Pension Fund Agency (WPFA) through Executive Order No___, 2014 and appointing our group PCAPII/Man from Asia Consultancy Group as the implementing group for the processing, management and distribution of Back-Pays/Pension Fund for Elderly Filipinos Attached are the Brief Project Proposal, Introduction, Executive Summary and Draft of the Implementing Rules and Regulation (IRR) for your perusal and approval. INTRODUCTION AND EXECUTIVE SUMMARY OF BACK-PAYS/ PENSION FUNDS FOR ELDERLY PILIPINOS (WAR REPARATION)

INTRODUCTION ALL NATIONS IN THE WORLD ARE SUFFERING FROM THE LONGEST AND BIGGEST ECONOMIC, FINANCIAL AND ENVIRONMENTAL PROBLEMS. ALL NATIONS INCURRED RECORD HIGH OF NATIONAL DEBT INCLUDING RICH AND DEVELOPED NATIONS. THE SOCIAL PENSION FUNDS PARTICULARLY BELONGS TO THE ELDERS WERE REDUCED AND TO BE REDUCED THAT THE POSSIBILITY TO BE ELIMINATED IS POSSIBLE BECAUSE OF SHORTAGE OF NATIONAL BUDGET ALL CURRENCY OF PARTICULARLY COUNTRY/NATION/S DEVALUED THE PURCHASING POWER DECREASED DOWN TO 50% THAT RESULTED INTO INFLATION OF PRICES. A.BACK-PAYS/PENSION FUND

EXECUTIVE SUMMARY BACK-PAYS/PENSION FUND FOR ELDERLY PILIPINOS Realizing that fact on how our Elderly Pilipinos received very minimal amount to sustain their daily living the Peoples Cooperative Association of the Philippines International Inc. (PCAPII) had collaborated and conceptualized a “Humanitarian, Environmental and Spiritual” Project aimed at addressing the Elderly Pilipinos needed economic support through providing the “Back-Pays/Pension Fund” to sustain not only their daily needs but also the extended family members through the interlocking environmental livelihood projects conditions The project will not only provide the needed economic support requirement for the Elderly Pilipinos but at the same time creating millions of permanent, sustainable employment, food security and environmental project solutions for the whole Pilipino nation through the project implementation of “Forever Green Project Program” and attached projects with main objectives 1st is to uplift the living condition of the poor Pilipinos, 2nd To protect the Mother Earth from total Environmental Destruction and 3rd To Return the Faith of the people to ONE GOD The “Back-Pays/Pension Fund” for Elderly Filipinos will come from Loan Project Program to be availed by PCAPII/Man from Asia Consultancy Group from World War I and World War II Reparation Commission. Repayment of Loan Funds are 100% responsibility of the Borrower/Project Proponent the PCAPII/Man from Asia Consultancy Group. Initial Project cost of US$1Billion and Nationwide Project Cost of US$38 Billion with minimum of Ten (10) years of catering the Economic Support for all the Qualified Elderly Pilipinos. Aside from “Returning the Respect” to Elderly Pilipinos, it will also provide, health support, housing, lifetime employment, clean and friendly energy, permanent source of food that would benefits not only the Elderly Pilipinos but the whole nation all the Pilipinos. The project will start in the Municipality of Sto. Tomas, La Union and to be duplicated in all the 171 Municipalities/Cities of Yolanda Typhoon area, in Luzon, Visayas and Mindanao nationwide. War Pension Fund Agency (Specialized Agency), Philippine Veterans Bank, Bangko Sentral ng Pilipinas, Philippine Veterans Affairs Office, National Statistic Office, Department of Interior Local Government, Office of the Senior Citizen Affairs, Department of National Defense, Department of Foreign Affairs Joint Circular No. November ____, 2014 After 100 years of the World War I, and almost 70 years of the World War II that brought incredible destruction, economic, psychological damages to the whole world that resulted of “Multiple Problems” that still affected the Pilipino people particularly the Elderly Pilipinos, the Executive Order No. ___ Series 2014 “Instituting the creation of the Specialized Agency called “War Pension Fund Agency” that will process, operate, manage, distribute the Back-Pays/Pension Fund to Qualified Beneficiaries the Elderly Pilipinos . The Specialized Lead Agency the War Pension Fund Agency (WPFA) Philippine Veterans Bank (PVB), Bangko Sentral ng Pilipinas (BSP), Philippine Veterans Affairs Office (PVAO), Department of National Defense (DND), Office of the Senior Citizen Affairs (OSCA), Department of Health (DOH), Philippine Health Insurance Corporation (Philhealth), Department of Social Welfare and Development (DSWD), Department of Agriculture (DA),National Food Authority (NFA),Department of Trade and Industry (DTI), Department of Environment and Natural Resources (DENR), Technical Education Skills Development Authority (TESDA) and Department of Foreign Affairs (DFA) hereby jointly issue, adopt promulgate the following implementing rules and regulations

RULE I- GENERAL PROVISION SECTION 1. Title These rules shall be known and cited as the “Implementing Rules and Regulations of EO No. ___, Series of 2014- “Back-Pays/Pension Fund” for the Elderly Pilipinos

SECTION 2: Coverage These rules shall govern the following: a.) Guidelines for the sourcing of Pension Fund/Back-Pays b.) Responsibilities of WPFA-Lead Agency, PVB, BSP, PVAO, NSO, OSCA, DFA, Banks, attached Agencies, and all Stakeholders c.) Guidelines for Qualified Beneficiaries d.) Guideline Back-Pays/Pension Funds Distribution e.) Guidelines and Mechanics of Implementation f.) Information and Education Campaign; and g.) Source of Reparation Fund The source of “Pension Fund/Back-Pays” to be distributed to the Elderly Filipinos is part of the of the Loan to be availed by the PCAPII/Man from Asia Consultancy Group from Global War Reparation incurred during the World War I and World War II including the United States Rehabilitation Act of 1946 fully describe on the following events, treaties, Congressional Act: War Date Treaty/ World War I 1914-1918 TOV World War II 1938-1945 TOP US Rehabilitation Act 1946 USCRA

RULE III. FUND SECTION 5. Fund Sourcing The initial amount of One Billion United Dollars (US$1,000,000,000.00) for the “BACK-PAYS” part of the total loan approved to PCAPII/MACG in the amount of “One Hundred Twenty One Point Eight Billion United States Dollars (US$121,800,000,000.00) from World War I and World II Reparation Commission deposited at the Hanging Account/s in several banks in the Philippines and foreign banks will be used and to be distributed as the “BACK-PAYS/PENSION FUND” to the Elderly Pilipino Qualified Beneficiaries

RULE IV. BENEFICIARY Section 6: Qualified Beneficiaries All Elderly Pilipino Citizens without any support receive from the government and private agencies born on or before the following dates: 1. Born on or before 1918 end of World War I 2. Born on or before 1945 end of the World War II 3. All Senior Citizens when reaching 60 years old in the time of implementation

RULE V. AMOUNT OF BENEFITS Section 7: Cash Value and In-kind The total of Benefits to be received by the Individual Beneficiary is on the following manner: Age Bracket (Spread) 1. Born on or before 1918 3 months 2. Born on or before 1945 2 months 3. Senior Citizen 60 years old 1 month

Section 8: Distribution Ratio of Benefits The Total Cash Benefits will be divided into the following manner: 1.Cash : 40%; 2. In-Kind :30%; 3. Interlocking Support Projects: 30% In-Kind Items: Medicine, Health Insurance, Health Gadgets, Tools, Vitamins, Food, Grocery, Rice and other basic needs of the Qualified Beneficiary Interlocking Support Projects: Livelihood Projects will be extended to Members of the Qualified Beneficiary as required as part of the Interlocking Requirement in Receiving the Back-Pays/Pension Fund

Section 9: Additional Other Benefits 1. Recreational tours, Birthday Party/Gift, Burial, eternal place & others

RULE VI. REGISTRATION OF QUALIFIED BENEFICIARIES Section 10: Office All Qualified Beneficiaries (Elderly Pilipino) will visit the War Pension Fund Agency (WPFA) Office to be established every Municipal and City nationwide near the Office of the Senior Citizen Affairs (OSCA), the Qualified Beneficiaries will be assisted by WPFA Employees for Official Registration

Section 11: Bed Ridden Qualified Beneficiaries All Bed Ridden Qualified Beneficiaries will be personally visited in their home for official registration to be conducted by the WPFA Employees

Section 12: Authorized Representative All Immovable Qualified Beneficiaries will Appoint Authorized Representative to receive and to collect the Cash and In-kind Benefits through signing of Authorized Representative Form during the Official Registration

Section 13: Biometric Identification Card All Color Coded BACK-PAYS/PENSION FUND Biometric Card will be issued to all Qualified Beneficiary upon official registration with System Arrangement to the Servicing Bank/s

Section 14: Disqualification of the Qualified Beneficiary: WPFA has the Sole Blanket Authority to decide on the Disqualification of the Qualified Beneficiary on the following ground: 1. Back-Pays/Pension cannot be used to any Illegal activities by the Qualified Beneficiary including the family members 2. Non-performance of the Qualified Beneficiary or the extended family members to do the Interlocking Livelihood Projects Any violation and non-performance committed by the Qualified Beneficiary and Extended Family Members is a ground for disqualification or stop releasing Back-Pays/Pension Fund Page 4-IRR/PENSION FUND/BACK-PAYS

RULE V. BANKS AND OTHER FACILITIES Section 15: Bank Services Bank Services for Qualified Beneficiaries Cash requirement will be catered by the WPFA Accredited Bank/s located within the Municipal/City for smooth and easy facilitation of transaction

Section 16: In-Kind Products and Goods Specialized Agency WPFA with PCAPII-Man from Asia Consultancy Group Bayan/Barangay Grocery and Botica will sustainably provide the In-Kind products, goods and services requirement of the Qualified Beneficiaries and giving priority to the local domestic products, good and services producers, provider and manufacturers in the area to be supported by all national and local government agencies concerned

RULE VI. PROGRAM VALIDITY and CAPACITY Section 17: Funds Availability The “BACK-PAYS/PENSION FUND” program will last till all the Pilipino Elderly catered the Benefits for the minimum of Ten (10) years starting from the first year of implementation to cater minimum Qualified Beneficiaries of Living Elderly Pilipino Heroes

E VII. RESPONSIBILITIES SECTION 18: Responsibilities of the SA (WPFA) The SA/LA shall: A. Lead Agency in the processing, claiming, coordinating, integrating Facilitating and distribution of the “BACK-PAYS/PENSION FUND” Cash and In-kind intended for the Qualified Beneficiaries Elderly Pilipinos born on or before the end of World War I, II & Senior Citizen B. Be the Sole Lead Agency in management, operation, distribution of the “ BACK-PAYS/PENSION FUND” intended for the Elderly Pilipinos born on or before 1945 end of the World War I, II and Senior Citizens C. Submit to the Office of the President the Action Plan on the BACK-PAYS/PENSION FUND” ‘ such as: - Brief Action Plan on the “BACK-PAYS/PENSION FUND Part of the War Reparation Fund of World War I and II - Number of Qualified Beneficiaries and Classification - Amount of Benefits to be received by each Beneficiary - Benefits in Cash and In-kind - Total Amount of “Back-Pays/Pension Fund” in yearly report - Project Locations and; - Schedule of project implementation Page 5-IRR/PENSION FUND/BACK-PAYS

D. Establish WPFA Office in every Municipal and City nationwide with complete office furniture, fixture, communication system and services located including Emergency Health need such as: Emergency Clinic, Ambulance complete with First Aid and Emergency Health Gadget and tools near to the Municipal and City OSCA office in coordination to the DILG-LGU E. Hire manpower within the Municipal/City as required in the official registration of the Qualified Beneficiaries and distribution of BACKPAYS/PENSION FUND in Cash and In-Kind goods, health services particularly Health Workers such as at least min. Two Nurse every Municipal/City, One Doctor for every District, One Ambulance Driver/ Heath Worker every Municipal/City for emergency transporting the Elderly patient to the nearest Health Facilities/Hospitals F. Coordinate to Servicing Bank/s for the distribution of “BACK-PAYS/ PENSION FUND” in Cash to all Qualified Beneficiaries nationwide located with in near to every municipal/city where the Qualified Beneficiaries residing with new “Over the Counter Assistance” by the Servicing Bank Employees G. Coordinate to Department of Health (DOH) and PhilHealth (Health Insurance) for Government and Private Hospitals for Health Service required for the Hospitalizations of the Qualified Beneficiaries H. Establish the Bayan/Barangay Grocery and Botica for the sustainable and permanent supply requirement for the In-Kind Benefits of the Qualified Beneficiaries such as; Medicine, vitamins, grocery, drinks, rice and other products available the vicinity including the arrangement the Birthday Gift/s, Party and Recreation Tour every year for the Elderly Pilipinos I. Establish the “Interlocking Project Center” mandatory required in receiving “PENSION FUND/BACK-PAYS” to Qualified Beneficiaries participation till capable to move or family members and will support the local products manufacturers/suppliers (OTOP) in the vicinity and Projects attached under the Forever Green Project Program, Clean and Green, Back-yard and Front-yard Gardening and other projects support by all national and local government agencies J. To establish and develop an Eternal Place (Cemetery) for every Municipal/City to be the location/s forever of the Qualified Beneficiaries Pilipino Elders decided to rest in peace with Burial support and services for Free K. To establish Council of Elders in every Municipal/City that will serve as the Moral and Spiritual Council in the particular vicinity, the Elders will elect the Officers by themselves and will receive salaries, wages and allowances in form of Per-Diem aside from their PENSION FUND/BACK-PAYS Page 6-IRR/PENSION FUND/BACK-PAYS

SECTION 19: Responsibilities of BSP The BSP shall: a. Serve as the Confirming Bank of the War Reparation Loan Funds/s transferred and deposited under the Hanging Account/s in all the Local Bank/s b. Mandatory to submit to WPFA all Banking Documents as requested related to War Reparation Loan Funds deposited under Hanging Account/s c. Required for mandatory to honor the Authorized Signatory of the War Reparation Fund deposited under Hanging Account/s based on the Federal Reserve Authorized Code (FRAC) Number and Immunity Serial Code Number d. Mandatory to following the International Banking Procedure being followed worldwide particularly in the remitted funds and transferred funds under Hanging Account/s

SECTION 20: Responsibilities of PVB: The PVB shall: a. Serve as One (1) of the Servicing Bank in distribution of “BACK-PAYS” to all Qualified Beneficiaries b. Required for mandatory submission of All Pensioners Name/s since 1946 up to present c. Required for mandatory to honor the Authorized Signatory of the War Reparation Fund deposited under Hanging Account/s based on the Federal Reserve Authorized Code (FRAC) Number and Immunity Serial Code Number d. Mandatory to following the International Banking Procedure being followed worldwide particularly in the remitted funds and transferred funds under Hanging Account/s

SECTION 21: Responsibilities of DND and PVAO: The DND and PVAO shall: a. Mandatory to submit to WPFA Office as requested the listing name/s and supporting documents as requested of All Veterans since World I and World II on filed starting 1946 up to present

SECTION 22: Responsibilities of OSCA The OSCA shall: a. Mandatory to submit to the WPFA Office as requested the listing name/s and supporting documents as requested of All Senior Citizens on filed

SECTION 23: Responsibilities of DILG-LGU The DILG-LGU shall: a. Mandatory to accommodate and provide temporary office space to WPFA Office while establishing the permanent WPFA Office in the vicinity Page 7-IRR/PENSION FUND/BACK-PAYS

SECTION 24: Responsibilities of DSWD The DSWD shall: a. Mandatory to submit to WPFA Office as requested the listing name/s and supporting documents as requested of All Senior Citizens with age bracket born on or before 1945 on file to be used as reference to the Qualified Beneficiaries

SECTION 25: Responsibilities of DFA The DFA shall: a. Mandatory to support and assist the WPFA Representative/s in foreign trips under diplomatic mandate in claiming, processing the War Reparation Fund from World War I and World War II

SECTION 26: Responsibilities of DOH The DOH shall: a. Mandatory to provide Health Requirement such as: Health Facilities, Services, health workers, medicine within the government resources, including coordination to Private Hospitals and Health Workers to pro-long the life of the Elderly Pilipinos

SECTION 27: Responsibilities of Philhealth The Philhealth shall: a. Mandatory to enroll all the Elderly Pilipinos into Hospitalization Philhealth Insurance for FREE providing all the health and financial support within their jurisdiction

SECTION 28: Responsibilities of All Health Stakeholders The Health Stakeholders shall: a. Declare All Hospitals, Health Products, Goods and Health Services to be accredited to WPFA, for minimum period of seven (7) years b. Follow in “ Strict” compliance in accordance to WPFA, DOH, PhilHealth Policy, Rules, Regulations in dealing to the Health Problems of the Elderly Pilipinos

SECTION 29: Responsibilities of DENR The DENR Shall: a. To support the PEESS Projects under the Forever Green Project Program (FGPP) and attached projects, particularly the Sustainable Project Solution on the Philippine Environmental Problems (SPSPEP) including support and provide the Environmental project program and resources applicable to the Qualified Beneficiaries and extended family members Page 8-IRR/PENSION FUND/BACK-PAYS

SECTION 30: Responsibilities of DA The DA Shall: a. To support and provide Agro-Forestry, Agro-Livestock, Aqua-Marine and other project program and resources applicable to the Qualified Beneficiaries

SECTION 31: Responsibilities of NFA The NFA Shall: a. Mandatory to allot Monthly One (1) Cavan of 50 Kilos Premium Rice (imported/local) for every Elderly Pilipinos to be delivered/pick-up and paid by WPFA/PCAPII Grocery and Botica based on the Regular Selling Price

SECTION 32: Responsibilities of DTI The DTI Shall: a. To support and provide the technical support in products quality, prices and suppliers to be delivered in Bayan/Barangay Grocery and Botica and all needed support to the development of the One Town One Product (OTOP) in processing, repacking, packaging products from Agro-Forestry, Agro-Livestock and Aqua-Marine project program and other resources applicable to the Qualified Beneficiaries

SECTION 33: Responsibilities of TESDA The TESDA Shall: a.To support and provide technical assistance in training, seminar, programs to Qualified Beneficiaries including extended family members in processing, manufacturing and producing available projects programs in the area

RULE VIII. Servicing Agreement to Bank/s available in the Municipal/City nationwide with protection included in Bank Products Services for releasing BackPays/Pension Fund through ATM Machine or over the counter releases B. Number of Qualified Beneficiaries every Municipal/City using reference Base on the OSCA, DSWD, DOH-Philhealth, PVAO, NSO, record will be Given the allotment of Twelve (12) Month budget or One (1) year Page 9-IRR/PENSION FUND/BACK-PAYS

SECTION 35: Beneficiaries The Living Elderly Pilipinos born on or before 1918,on or before 1945 and Senior Citizens are the direct beneficiaries of the “PENSION FUND/BACK-PAYS”, The “Domino” effect of “Multiple Problems of Economic Slavery and Poverty ” will be solved on the last remaining years of the Elderly Pilipinos including family members will leave in prosperity and peace

SECTION 36: Guidelines for Computation “PENSION FUND/BACK-PAYS” in Cash and In-kind will be based on the WPFA formula The Birthday of the Qualified Beneficiary will be the bases in computation of “Pension Fund/Back-Pays” in Cash and In-kind Date Age Bracket

SECTION 37: Registration of Qualified Beneficiary The WPFA Office will do the official registration of Qualified Beneficiaries to WPFA Office Located every Municipal and City nationwide with the following form and documents to be issued: A. Official Registration WPFA-Member Form signed or Thump mark of the Qualified Beneficiary B. Waiver of Quit Claims to All Human Rights Cases in any domestic and foreign court/s except for the International Court of Justice case/s if any C. Authority of Representative in-case of immovable Qualified Beneficiary D. Biometric Coded Identification Bank Cash Card will be issued in-favor of the Qualified Beneficiary after the Official Registration (to be released within 3 days) E. Signing Benefits 1) Cash US$500/P= and 2.) In-Kind worth US$500/P=

SECTION 38: Cut-Off Date in receiving Pension Fund/Back –Pays and Inkind Benefits The Qualified Beneficiary will start to receive the Back-Pays and Monthly Pension Fund on the following manner:

CASH: A. The Qualified Beneficiary born on or before 1918 will receive the balance of Back-Pays of US$2,000/P= in the coming two (2) months or US$1,000 each month on 40%-30%-30% (Cash,In-kind 7 livelihood support) schedule to be released every 1st week of the month and the Monthly Pension Fund of Twenty One Thousand Pesos (P21,000) Page 10-IRR/PENSION FUND/BACK-PAYS

B. The Qualified Beneficiary born on or before 1945 will receive the balance of Back-Pays of US$1,000/P= in the coming month or US$1,000 on 40%-30%, 30% Cash, In-kind & livelihood support) schedule to release every 2nd week of the month and the Monthly Pension Fund of P14,000 C. The Qualified Beneficiary Senior Citizen reach 60 years old in time of implementation will receive the Pension Fund of US$1,000 on 40%-30%30% (Cash,In-kind and livelihood support) schedule to be released every 3rd week of the month in the amount of P7,000 IN-KIND: Qualified Beneficiary will be informed in advance where to pick-up or to deliver the In-kind products, goods and services

SECTION 39: Mechanics in withdrawing of PENSION FUND/ BACK-PAYS of the Qualified Beneficiary of Servicing Bank/s Only Registered Qualified Beneficiary with their Individual Biometric Coded Cash Card is entitled to withdraw the BACK-PAYS/PENSION FUND to be assisted over the counter Servicing Bank Employees to avoid Impostor Beneficiary

SECTION 40: Funds and In-kind availability WPFA Office make sure the available Funds and In-Kind for the “PENSION FUND/BACK-PAYS” is good for Seven (7) Months to cater the “Pension Fund/Back-Pays” and In-kind Requirement of the Qualified Beneficiaries In-case of Fund Shortage and In-kind Supply Shortage the WPFA has available stand-by Cash and Supply In-kind good for Five (5) months

RULE IX. INFORMATION AND EDUCATION CAMPAIGN (IEC) SECTION 41. Beneficiaries and Mechanics The SA/LA/WPFA, OSCA, DILG, DSWD, DND, DOH and PhilHealth will conduct necessary IEC to support the “BACK-PAYS/PENSION FUND” for the Elderly Pilipinos. The PIA is requested to assist in the conduct of IECs and all government agencies are enjoined to provide the necessary support to the WPFA, shall required all OSCA Offices to post the IEC materials in their establishment, for this purpose the WPFA and OSCA shall use the appropriate the tri-media to inform the public motorist beneficiaries

RULE X. REPORTS SECTION 42: Report to WPFA The Servicing Bank/s, PCAPII-Barangay/Bayan Grocery, Registration Division, Financing Division, Interlocking Projects Division, Council of Elders, Other Benefits Division shall submit to WPFA report on the implementation of the revival of “BACKPAYS/PENSION FUND” within one (1) month from the start of assistance and every month thereafter until the “PENSION FUND/BACK-PAYS” has fully implemented Page11-IRR/PENSION FUND/BACK-PAYS

SECTION 43. Report to the Office of the President The WPFA- PCAPII shall submit a report on the status of the implementation of the “BACK-PAYS/PENSION FUND” for the Elderly Pilipinos to the Office of the President within Seven (7) months from the receipt of the report of Servicing Bank/s and all concerned divisions. Such report shall be submitted every Twelve (12) months thereafter until the of “BACK-PAYS/PENSION FUND” has been fully implemented

RULE XI. FINAL PROVISION SECTION 44: Governing Clause Any request for clarification on any provision of this IRR shall be referred to the “SA-WPFA”, which shall resolve the matter in coordination with the OSCA, PVAO, PVB, DSWD and DND and other concerned national and local agencies

SECTION 45. Separability Clause Any rule or regulation inconsistent with the provisions of this IRR is hereby repealed or modified accordingly.

SECTION 46. Effectivity This IRR shall take effect immediately upon publication in the newspaper of general circulation
