I, Kumar Jha aged about 24 years S/o Sh. Ram Kumar Jha having his office at 1/26 , First Floor, Kirti Nagar, WHS, W HS, New Delhi  –  110015, do solemnly affirm and state as under: 1. That I am the st store ore manager and the authorized representative of the petitioner in the above mentioned matter and well conversant with the facts of the case and hence am competent to swear to this affidavit. 2. That no appeal is maintainable against the judgement and decree dated 01.09.2015 in Suit No. 341 of 2015 as the same is the consent decree by the way of settlement between the Petitioner and the Respondent herein, wherein an undertaking was also given by the Judgement Debtor (Respondent) that the cheques which they had handed over the Decree Holder, the same shall duly be encashed. 3. However neither any appeal has been preferred by either of the parties before any court nor any an y stay has been granted against the said judgment and decree dated 01.09.2015 in

 

Suit No. 341 of 2015 by any court, to the best of my knowledge 4. That I hav have e gone through the contents of the instant affidavit which has been drafted by my counsel on my instruction. I say and I submit that the same are true and a nd correct tot the best of my knowledge and belief and are based on the records made available to him by me. 5. That the annexures, if any of the true copies of their respective originals.
