PETITION COMES NOW the petitioner and before this Reconstituting Officer Register of Deeds, respectfully states;

thru the

1. That petitioner is of legal age, Filipino, married and resident of Block 4 Lot 5 Phase II Countryside Homes, Tayud, Lilo-an, Cebu; 2. That the petitioner is the registered owner of a parcel of land covered by and described in Transfer Certificate of Title No. TF15029 of the Registry of Deeds of the Province of Cebu; 3. That the original of the aforesaid Original Transfer Certificate of title on file with the Registry of Deeds of the Province of Cebu was lost or destroyed due to fire ; 4. That submitted herewith are the following papers in support of this petition; a. Owner’s duplicate Certificate of Title and three 3)Xerox copies thereof. b. Real estate tax receipt representing full Payment for the last two (2) years prior to the filing of this petition; c. Latest Tax Declaration d. Photo copy of marriage contract

PRAYER WHEREFORE, it is respectfully prayed that the original of Original Transfer Certificate of Title No. TF-15029 destroyed in the files of the said Registry of Deeds be ordered reconstituted on the basis of the owner’s duplicate certificate of title and in accordance with Republic Act No. 6732. VERIFICATION I GIRLIE SY- Reconstituting officer of the Register of Deeds- Province of Cebu after having been duly sworn to in accordance with law, deposes and says: that she is the petitioner; that she caused the preparation of the foregoing petition; that she has read the contents thereof and the facts stated therein are true and correct to her knowledge.

AFFIDAVIT REPUBLIC OF THE PHILIPPINES ___________________________)SS x---------------------------x I, DAISY V. OROFEO-STA.INES, Filipino of legal age, married and a resident of Block 4, Lot 5 Phase 2, Countryside Homes, Tayud, Lilo-an, province of Cebu, Philippines, after having been duly sworn in accordance with law hereby depose and state: 1.

That I am the registered owner of the parcel of land covered by Transfer Certificate of Title No. TF-15029; of the Registry of Deeds of the Province of Cebu;

2. That the original copy of the aforesaid Original Transfer Certificate of Title on file with the Registry of Deeds of the Province of Cebu was lost or destroyed due to fire; 3. That no deed or other instrument affecting the property had been presented for registration, or if there is any, the nature hereof the date of its presentation, as well as the names of the parties, and whether, the registration of such deed or instrument is still pending accomplishments; 4. That the owner’s duplicate certificate is in due form without any apparent intentional alterations or erasures; 5. That the Certificate of Title is not the subject of litigation or investigation, administrative or judicial, regarding its genuine or due execution or issuance; 6. That the Certificate of Title was in full force and effect time it was lost or destroyed; 7. That the Certificate of Title is covered by regularly issued by the Assessor’s Office, and

8. That the Real Estate Taxes have been fully paid up to at least two (2) years prior to the filing of the petition for reconstitution. 9. That the corresponding owner’s duplicate of said Transfer Certificate of Title No. TF-15029 was lost or destroyed in the possession of The Registry of Deeds under the following circumstances: The office building of the Registry of Deeds was got by fire and it burned down portion of the office of the Registry of deeds- Cebu Province and it includes 10 percent of the total number of copies of Original Certificates of Title and as such destroyed copies was less than five hundred copies and part of it was the copy of my Certificate of Title. 10.That this owner’s duplicate of the title is being submitted as basis for administrative reconstitution pursuant to Republic Act 6732; 11. That I am executing this affidavit in connection wit my petition for administrative reconstitution of the original copy of Transfer Certificate of Title No. TF-15029; Further affiant sayeth not.
